2 weeks ago I have received a letter from NY that my case as a skilled worker was finalized and that i needed to send them my passport for the issuance of the visa. A few weeks prior to that I got my CAIPS files that indicatedd that I did not have any problems. I overnighted my passport to them with 4 pictures. In a few days I got this by email: Dear Sir,

The letter sent to you on 23 Sept 2010,which requested your passport (s) for the finalization of your immigrant case, was sent to you in error. We are
currently not in a position to issue your visa (s) at this time. Please refrain from sending your passport to our office.

You will be contacted in the near future with further instructions. You can expect to have your immigration case finalized within the next 60-90 days.

We are sorry for any inconvenience that this may have caused.

New York, New York"

Has anyone had a similar issue.

Hi,

What a co-incidence! I got a similar e-mail (with exactly the same wordings) from the Canadian consulate, dated 5th Oct. It indeed is shocking to receive such a letter. I'm totally confused now, and not sure how to proceed. My passports (and my family's) have already reached the Canadian consulate in the US. The worst part is, I had to take all the pains to send my passports from India, through one of my close associates (who carried my authorization letter) who travelled to the US last week.

I'm not sure whether they'd safely mail my passports back to the return address in the US that I have provided. I'm in a fix now. Please keep me posted if you receive further communication from the consulate. I really hope this whole e-mail thing is an error. Thanks.

I am so glad to know that I am not the only one to receive this email. Do you know why this email would have been sent and what course of action are you taking? Are you replying to the email asking about the same or calling NY inquiring about the case? Has this to do anything with the new regulations that they removed certain occupations from being eligible for permanent residency application?

Please update this thread if you know anything or get any further information from consulate
 
I believe the quota of skilled worker class visas for 2010 has reached its limit at NY VO. And they will probably consider visa stamping in 2011.

The same case had occurred with one of my friend. He received visa request in Nov 2009 but Islamabad VO refused later to stamp it due to same reason. However, he was requested again in Jan 2010 to submit his passport & got passport with maple leaf within 35 days :)

In your situation guys, i believe that they only ran out of quota for this year, and did not realize the matter before sending the PPR.


Hopefully all of you will get the visas so soon.

Does that means quota system would apply to all even if they have applied before 26 June? I am FSW applicant & applied in 2009; I had impression that before June 26 2010, there was no quota system for FSW. Can you please correct/share more on this?

According to everything I have seen and read, the quota only applies to post-June 26th applications. It's unlikely that is the issue, it's probably just a routine mistake, like they sent out the letter whilst they were still waiting for some security check to come back.

Oh no, do not get confused about it:

Running out of quotas is not a new thing, it is not related to the new rules or any stuff like that. It happened many times in the past even before the year of 2008. (Usually if they run out of quota, it happens during the last quarter of the year).

Each visa office has a certain number of visas to issue every year, if they use all of their visas, they ask the applicants to wait for the next year to get their visas, sometimes they say it clearly in their letters to the applicants, other times, they just ask them to wait.


Your cases who applied before June 26, 2010 are safe and treated (processed) under the rules which were in effect when you applied.

you will get your visas, as soon as they get the new visas for 2011 regardless anything else, neither other requirments will be asked (in case the reason was only running out of quotas not anything else), nor new rules will affect your cases until it is completely finalized.


Do not worry, you are all safe. (they always process and finalize the applications based on the rules in effect at the date of receiving the application - date of applying at the CIO).

Anyway, I'm so sorry to here the bad news for you guys. It won't affect me much, but I know that you guys who are desperately waiting for the PPR would be shock receiving those email.
 
did everyone get that letter as an email or did some one get in hard copy as well? To all who got the letter to wait, did anyone respond or reply to the email to confirm about it or you are just going to wait till you get another response from the immigration dept? The reason I am asking is because the original letter that we got in hard copy is asking to send passport within 60 days and now we got this email not to send it. Please let me know if you guys are taking any action or just accepting the email and waiting?

I sent in my passports a week ago and 3-4 days ago my online status changed to 'Decision made'. Do you think they have stamped my passport? I haven't received this letter that you guys are talking about.. yet, anyway..
