Hello,

I am a Canadian(born Canadian, with passport, social number, etc) that received a job contract in South Korea, I've been staying here for 2 years. Anyways, in this time, I married a Korean girl.

As my contract here in korea is finished, I will be moving back home. I've been trying to read the CIC.gc.ca site, but finding it very confusing.

Here are my questions....

1. Is there a link or site I can navigate to find this information?
2. Which visa do I apply for? Is it the "Sponsor Family"?
3. Will she be allowed to stay for prolonged period or will she need to leave country every 6 months?
4. Will she be able to work?
5. Is this different then a permanent residency visa?

From the CIC website you can download the forms you need.

2. You will apply for: Sponsorship of a spouse under the Family class.

3. Your wife will be a visitor until her application gets approved. She can apply for an extension after the 6 month period, but it it not guaranteed that she will receive it. You have two choices: either file an outland application (her case will be process at the Manilla visa office - average time is 14 months) or file an inland application (her case will be processed in Canada - average time is 19 months).

4. She will not be able to work.

5. This is an application for permanent residency under the family class.

1. You are better off to apply outland since Koreans are visa-exempt to Canada. All the outland forms are here: http://www.cic.gc.ca/english/information/applications/fc.asp

Time shown on CIC website are not average times. They are worst case for 80% of applications. The "average" time for processing in Manila (50% times) is around 9-10 months. So your total time would be 1 month for sponsor approval, then another 10 months for applicant approval... so just less than 1 year total (hopefully much quicker if you're lucky).

3. If she just comes as a visitor while the outland app is being processed, then she will most likely get 6 months status. At around the 5 month mark, she can apply to extend this. Many people have successfully gotten a 12 month extension.

4. She can't work unless she applies for special work permit. This is independent from the outland PR app. Korea has some working holiday visas she could also apply for that allow you to work here for 1 year (this is how my wife first came to Canada).
