husband unwilling to finish landing procedure

Hi everyone,

Could anyone share similar experience:

Husband and wife with a small child applied for express entry together with the wife being the main applicant. The wife qualifies for EE without the husband. In the event they receive Copr and the husband refuse to finish landing procedure with the wife, what would happen to the wife's application if she informs CIC due to martial dispute husband is reluctant to finish the landing? what would happen to the wife's application if she finish landing by herself and finalize divorce later?

Kindly share similar experience and timeline. Thank you so much.

You don't need to inform IRCC if your husband decides not to land. His COPR would just expire. Nothing happens to your app. You land and become a PR.

Yes, if the wife is the primary applicant, she can land and become a PR without the knowledge/consent of the husband. However, I'm not certain what happens to the child in such a case - not sure whether you need consent for the child to land.

The wife can land without issues.

The wife will need the husband's written consent to bring the child with her to Canada.

hi everyone,

If the wife inform IRCC her husband and child will not land due to martial dispute and only she will land will this require re-processing of their application and change result? or should the wife go ahead and do a soft landing alone and then file for divorce after 6 months to finalize on child custody?
