Hi,

I want to know that if some one have Canada pr and they choose to give their child birth out side Canada like in India then how to apply for child pr. if he is out side Canada.
 
we r currently doing that(thro indian Visa office)...One of the parents has to return back to canada and sponsor the child...its just like spouse sponsorship but some documents are different...

are we able to do it from India with out going back to Canada? I have my all documents with me in India.

if my job running in Canada and I am on leaves which approved by my employer.My citizenship is due and not yes claimed?

As a PR, you must be resident in Canada to sponsor your child. There is some splitting of hairs concerning if you are still resident in Canada even if you are on a short leave in India but if immigration finds out that you are trying to sponsor your child and you are not in Canada at the time, they may well deny your application. In order to be in Canada and sponsor your child, you can either go to Canada yourself and leave the mother with the child in India or you can apply for a TRV for the baby to come with you. If the TRV is denied based on that the baby will be staying in Canada permanently, then you can apply for a TRP.

Being due for Canadian citizenship is irrelevant. If you become a citizen before your baby is born, your baby will automatically get citizenship. If not, then you are still a PR and need to sponsor your baby for PR.
 
but I am still not able to understand that why PR holder need to be in Canada when he is able to provide all the document and proof of being back in Canada to rejoin the job.

and if PR holder go back to Canada and apply from there and then after applying can they come to India back while application is under process...
 
I just dont know the answer for myself...maybe experts can help...But i thinks its not a good idea to come to india when appln. is under process they may reject...currently my hubby is in canada and i am in india with my 5 month old and we are waiting for our baby's PR :)

Because it's Canada immigration and Canada makes the rules. They do not want to give all of your family PR unless you are living in Canada. A Canadian citizen is allowed to sponsor spouse and spouses children for PR even if he is living outside Canada but he must provide proof that they will be moving to Canada at the time they get their PR. If he fails to prove this, he will also be refused.

It is not really safe to go back to India at any point while the sponsorship is being processed, maybe only for a very short trip because if immigration tries to contact you and finds out that you have gone back, they will likely refuse your application.

If both father n mother of the child is having PR, then mother can stay back with child in India and child's father can sponsor PR to that child. Or otherwise you have to leave your child in India after 3-4 months from birth and then goto canada and apply for child's PR. since u and ur kid r apart, may be officials will understand your situation and chances are there to speed up the process ...
