Hi All,

I am having objection regarding my spouce PR with Canada. Let me elaborate scenario first.

Since last three years, there were some matrimonial disputes, and due to which legal matters are going between us currently in Indian courts.

There is criminal proceeding as well against my spouse, for which she took stay in Indian HC but FIR is still not squashed but she left India in between proceeding.

I just come know location of my spouse, which is waterloo, ON, Canada on PR basis which I confirmed from organization for which she is doing job.

As far as I know about Canada immigration process, NOC required from other spouse during PR process. And I doubt that she got PR on single status and not married status.

In such case, How can I get in touch with Canadian Immigration Officer and get PR details by providing supporting documents like Marriage Reg Certificate, Passport number with copy of her and her present location in Canada.

Is it fine as per Canadian law, or is it fraud to Canada govt? if yes then to whom I can report?

Please let me know your feedback on this as soon as possible.

If you are legally separated or if your spouse has filed for divorce, then she can immigrate to Canada without include you in her application. She would have provided police certificates from India as part of the immigration process.

CIC will not provide you with information about her or her status in Canada. This information is confidential and CIC will not share it with you.

However you can certainly file a report with them if you feel she has committed fraud.
 
Somewhat off topic, but I find it extremely disturbing that there are "organizations" that will blindly hand out personal information without consent. Hopefully, if you do file a report with IRCC someone there has the good sense to run this organization over the coals for breach of confidentiality or at least report them to the government body in Ontario that takes care of PIPA.
 
She is not legally separated and not filed any divorce petition against me. And she is showing that she has to leave country due to onsite project assignment with TCS organisation which should be working visa base, but TCS department confirmed that she left to Canada on PR basis.

As far as I know she has shown her status as single and passport in which haven't added my name as spouse.

Can you get me the exact link or address where I can attach marriage certificate, passport details and organisation snapshot and report for her?

You can report fraud here: http://www.cic.gc.ca/english/information/protection/fraud/report.asp

After that, it's out of your hands. Immigration may or may not investigate her although if they find that she is married but applied as single, she would have a problem. If she applied as separated, she might not have a problem as many countries do not have legal separation and the fact that you are no longer a couple and no longer living together could be seen as a separation.

Is it possible that she already had PR when you met her?
 
There is no possibility that she already had PR when we met and got married.

She applied for PR after marriage only and presently we are not staying together but legally we are married and not separated. That's the fact.

Are you sure? Once she has been in Canada for a year she can file a divorce petition from here. Maybe she filed one here and you just don't know about it.

Anyway - you can certainly report her to CIC. Do not expect CIC to provide you with any information about her or the outcome of their investigation.
 
Yes Scylla,

I am sure that she hasn't declared her marital status as Married and hence she didn't required spousal NOC.

Even in her passport she hasn't updated husband's name and showing her as single.

As far as I know if things come under observation of Canadian background check, and found as misinterpretation, one can be banned for 5 years for PR.

Guys, I request you to help so that I can bring in notice to Canadian Government, so that in Canada she cannot further cheat someone else.
