Dear Seniors Please advise

I am in a unique situation .. i hope all have been through this situation.

I with my wife and 2 kids landed in Jan 2016. It was a short landing for 2 weeks. We finished the formalities of landing and returned back. We were expecting that the PR cards will arrive in 2 months.

But unfortunately the PR cards for all of us arrived last week. Now that my wife is 8 months pregnant, the airlines refused for our travel. We planned to deliver in Canada but seems that is out context.

Now she might be delivering next month. I would like to ask the seniors how can I get the Visa or Travel document for the new born

please advise

What country is the child born in?

If the child is born in a visa exempt country, the child can board the plane to Canada. You can then start paperwork in Canada for PR dependent sponsorship.

If the child is born in a non-visa exempt country and/or cannot acquire citizenship of country born in, the airlines cannot let the child board plane to Canada until child has PR. One of you need to return to Canada and start PR dependent sponsorship while the other remain behind with newborn until child obtains PR status.

In the meantime, you can try to apply for TRV for your child however it will be quite difficult obtain since CIC knows the child will not leave Canada at end of TRV. There is a TRP procedure also but I am not familiar with TRP so I cannot go into details about it.

Is this true? I am Canadian citizen full born here Halifax all my life. I am maybe delivering in India. My husband and I had planned to go back and forth 6 months between Canada and India and he should have his PR by the time we have a baby. (we are doing IVF in India next month so if successful, it would be around April 2017) I am planning to go back to India in Feb 2017 for about 6 months... have the baby and all 3 of us come back.

Since I am a Canadian born citizen, will the child be able to come back with me? Or do I need to leave my baby with his family and come back to Canada and take possibly up to 17 months for the baby's PR? Can this process be initiated before the birth? I am sure babies have been inadvertently born in foreign countries before... and I cant see it taking up to 18 months to get that child back to Canada with you! (It still states 17 months waiting time for family class).

I thought there was a waiver or way to get a temporary visa for the child so you can apply for their documents when you get back to Canada?

The child will be born Canadian by Descent through you. So you will need to submit proof of Canadian citizenship certificate and limited Canadian passport for newborn same time. Provide proof that you submitted a application for proof of Canadian citizenship with Canadian Limited passport. The passport will be good for 2 years. The newborn will be able to fly with you to Canada with this limited passport.

You can start the paperwork for both proof of citizenship and passport after the child is born. While CIC knows that citizenship certificate would take a few months, so they will give you a limited 2 year Canadian Passport within a few weeks. You would need to show proof of immediate or near travel plans so that they can issue child a limited passport.
