I hold PR and work in Canada, and my parents hold US citizenship and were visiting family in Canada. We had extended their visit, and I still need them to stay for the coming 16 weeks. Our latest Record Extension was only approved for my dad but refused for my mom (with very strong language but not very clear reasons) despite being applied at once by my dad being the representative of my mom. I am about to undergo some medical treatment that needs maximum support from family.
My main question would be: What would be the best course of action for us, so that my mom is with us soon before my procedure starts but also does not have any flags or “black points” in her file for potential future visits to me in Canada:
1) let my mom leave and return? If so, is returning on the same day, week, or month a minimum acceptable time? The reasons we haven’t done this already is the confusion with my father (her representative’s approval and her refusal and because traveling at her age is not our first preference).
2) use a web form to appeal?
3) use a reconsideration form?
4) use a restoration application?

Based on your application and accompanying documentation that you have provided, I have carefully considered all information and I am not satisfied that you meet the requirements of the Immigration and Refugee Protection Act and Regulations. Your application as requested is therefore refused.
[X] You are a person in Canada without legal status and as such are required to leave Canada immediately. If you do not leave Canada voluntarily, enforcement action may be taken against you.
Persons wishing to extend temporary resident status in Canada must satisfy an officer that they will leave Canada by the end of the period authorized for their stay, that they will not contravene the conditions of entry and that they do not belong in a category of persons inadmissible to Canada under the Immigration and Refugee Protection Act.
In reaching a decision, an officer considers several factors, which include the applicant’s:
1. Reason for original entry and reason for requested extension;
2. Ties to country of permanent residence, including:
- employment and study commitments;
- family ties and responsibilities;
- status (citizenship or immigration status);
3. Financial means for the extended stay and return home;
4. Travel and identity documents;
5. Probability to leave Canada at the end of authorized stay.
After considering all the circumstances of your case, I am not satisfied that you meet the requirements of the Act and Regulations.
You must leave Canada on or before the expiry of your current document or, if your document has already expired you must leave Canada immediately. Failure to do so could result in enforcement action being taken against you.
