How much is the chance of not being reported of failing to comply with the RO?

We landed Canada on Dec. 19, 2011 by car from US-Canada border, then came back USA on the same day. We have never been back Canada since then. Our PR card was forwarded to us by one of our friends in Canada several months later. The PR card has an exp date of Feb 10, 2017.

If we want to go back Canada after Dec. 19 2014, is there any chance that the border officer will not file the section 44 report (for failing to comply with the residency obligation)? If yes, what can we do to increase our chance of not being reported?

There is nothing you can do to decrease the chances of being reported for failure to meet the RO other than to meet the RO and not risk being reported at all. Because you will be traveling via land and you will be returning at roughly the 3 year mark, you should be ok to meet the RO and likely you won't be reported. Just remember the longer you are gone the higher the risk becomes.
