We own an in-home senior care business, our trained Caregivers provide care of varying levels to seniors in their place of residence. We would like to help one of our staff with her immigration through the Home Support Worker Pilot program, however her lawyer is telling her that as an 'agency' we do not qualify and can't help her.

On the IRCC site it states the job offer must come from:
  • from a single Canadian employer
    • The employer cannot be an embassy, high commission or consulate in Canada.
    • The employer can comprise more than one individual (for example, Mr. and Mrs. Smith), but must constitute one simple employer (that is, one single CRA business number).

Lawyer is correct. She doesn't qualify for the Home Support Worker Pilot program.

Why would that be? We are offering her full time work with a live-in client, she is getting the hours required, she is paid via payroll with CRA deductions, etc...
