HIV POSITIVE - CAN I APPLY FOR PERMANENT RESIDENCY OF CANADA

As a child I was a landed immagrant in Canada and still hold the document stating this.

Subsequently, my parents split up and we moved overseas although my father remained and remarried and holds a full Canadian passport (which I have a certified copy of).

I hold a British passport and HIV+ on medication.

Would I be able to move back to Canada and immagrate taking up permanent residency?

You would have to apply for PR from scratch through one of the economic immigration streams like Federal Skilled Worker or the Provincial Nomination programs.

Since you are HIV positive, it's quite likely CIC will inform you that they intend to deny you based on your condition and the pressures this will place on the Canadian health care system. You will then have to provide evidence that your condition is stable and that the costs of your care and medication won't exceed certain maximums. It's impossible for any of us to say how this will turn out for you. But you can certainly try.

I would say that you first challenge to applying won't be the HIV - but qualifying to immigrate. Have you looked into Canada's various immigration programs to understand what it takes to qualify to apply? Note that your father cannot sponsor you. You will have to qualify on your own.

See how many points you have under Express Entry. Note that no one with fewer than 450 points has been selected to date. You will lose a significant number of points due to your age. Hopefully you can overcome this with education and experience points.

Before you can formally submit your profile, you will need to have your education formally assessed and also take an English language test (mandatory for all).

Does anybody know what we have to do to the medical don't declare excessive demand on health? And does anybody know what immigration plan we must show in case of procedural fairness?

This is how the government calculates whether you will be an excessive demand as has been explained to me by an immigration lawyer who specializes in hiv cases:

The annual cost per average Canadian in the health care system is about $4000-5000 (i can't remember exactly). To be admissible your estimated costs for the next 7 years would have to fall under this.

So are you inadmissible because you have HIV? Technically the answer is no. But even if you were newly infected, and stayed healthy for the next 10 years, the costs of routine checks would basically guarantee you to go over the annual average of $5000. For example, a cd4 test here costs about $240, viral load test (i can't remember but more than the cd4). Canadian doctors usually check both of these tests 3-4 times a year, plus other blood tests, plus doctors fees, medication. Most Canadians are not aware of how expensive everything is, but everything has its price tag. Moreover, if you are not healthy (eg low cd4), your immigration doctor will calculate the chances of you being hospitalized for an opertunistic infection etc... Also, i have heard that if you already started HAART this would deffinately put you above the annual average.

This goes with every disease... there is no special rules or categories for HIV. If you have diabetes type I you are basically in the same situation. It doesn't matter which country you are applying from. If you were coming from France and you had diabetes you would be inadmissible.

Different rules. You are exempt from excessive demand. Your HIV status won't be a barrier to you being sponsored through family class.

I didn't say "it depends". I said that people under spousal sponsorship are exempt from excessive demand. If you are being sponsored under spousal sponsorship, then I would recommend you post in the Family Sponsorship section of the forum. You're posting in the wrong section right now.

Again, you're posting in the wrong place on the forum. As I've explained, the medical rules for the skilled worker class are completely different than the medical rules for the spousal sponsorship stream. Any information you get here will not relate to your case. Once again, you need to post your question in the family sponsorship section of the forum.
