Hi,
I am a 17 year old high school senior that is currently living in Macedonia. Prior to this I had lived in Canada since I was 6(prior to that my family was living in Dallas, Texas in the us). Ever since I was 6 I had never left Canada and had been attending school their since the first grade until I finished grade 11, summer 2012 when my parents convinced me to go back to Macedonia(small country in the balkans) to visit my birthplace and get to know the rest of my family. Since I had never been their since I was 3 years old I agreed.

I arrived their during mid July 2012 and attended a local english private school for a semester. I was originally planing to graduate their and come back to Canada for college but then I realised how the school was designed to cater for people that wants to learn english, instead of native english speakers such as myself. Which left me lost. I needed a translator nearly everywhere I went, I was failing all my non-english classes and those those that were in english were all science oriented classes which isnt my strong suit so i got away barely passing.I also realised how much I miss my friends and my life in Canada, since I was having trouble socialising with people that arnt comfortable speaking english.

Id like to add that I am not a citizen nor a permanent resident card holder nor is my parents. How ever I have 4 younger siblings that were born in Canada that are citizens. My father is currently living in a rented house in Canada under a work permit. My mother and siblings are here with me in Macedonia also trying to gain re-entry. Although neither my parents are skilled. My father has been driving tour buses and trucks and is a very experienced and qualified driver. My mother has a diploma from a Canadian university in nursing. Which qualifies her to be a nursing aide. But im sure neither of those technically counts as skilled.

Right now school is out and im in-between semesters. What I am trying to do is get a visa go to Canada and transfer back to a Canadian high school for the new semester. Id like to graduate this year. But if push comes to shove I am willing to repeat grade 12.

My mother is taking a trip to the nearest Canadian embassy in Vienna to get a temporary multiple re-entry tourist visa. But she says that if I were to also request a visa it would ruin her chances and then neither of us could leave. She says its much better if she leaves first then I try to get a visa separately. Although that would mean I would have to spend another semester here and miss being able to graduate alongside my friends. Also I would probably fail the year ruining my chances to get in to a decent university.

If anyone could give me some advice or knowledge on how to accomplish this I would really appreciate this.
 
There isn't much future in it for you staying in Canada on a visit visa. What province is your father driving in? He should consider going to a province where truck drivers can be sponsored for PR by their employers. If your father is able to apply for PR, he can include your mother and you as long as you are single and either under 22 or over 22 and a full time student.

He lives in Alberta and I know about PR the problem is it takes to much time and I will miss the semester.
Im kinda trying to get back before the new semester starts or at least on the first month.
 
The only way you can get back immediately is applying for a visit visa. I do not know if your mother is right and that you applying now would mess up her application. Since you were in Canada for a long time already, immigration may feel that now you are outside, maybe they should not give you a new visit visa in case you are not planning on staying in Canada temporarily. If you can't get a visit visa, you would not be able to go back.

For the future, without a PR, you would need a study permit in order to continue to study in Canada and you would have to pay international tuition fees which are about 3 times what a PR would pay. Your father can also not stay on a work permit forever. In 2011, new rules were set and from then on, you can only stay on a work permit for 4 years, then you must leave for 4.

My mothers believes that since I am a minor and have no guardians in Macedonia, me staying here would really insure the embassy that she will be returning for me.

As for pr. My father is planning to do pr very soon and yes he is a long haul truck driver. The visas are just so we can enter the country sooner. My mom needs to enter in order for my citizen siblings to enter and continue their education( they currently enrolled in an online school). She believes she has a strong chance to do so as long as I remain.

Although I still believe I can some how convince the embassy that I belong in Canada and they would allow me to enter Canada on a visit visa just until my dad goes pr.
 
I have heard that once a person has been nominated by the PNP, they and their family are not considered an issue for overstay any more. How close is your father to getting his nomination?

Your mother may be right and immigration may see her as not planning to overstay if she leaves you behind. However, she is taking the other kids with and they may look at it that way that you are 17, almost adult, maybe she really is planning on staying in Canada permanently and is just leaving you behind because even though you are still a minor, you are almost old enough. As far as immigration knows, maybe you didn't even want to go with them.

I've spoken with my father he is very close to being nominated. According to him it should be in a few months. Unfortunately by then it would be too late for me or my siblings to get into any school this semester.

As for your second point. I never really thought about it like that. Ill go talk to her about this and see what her take is on this issue. Id also like to add she is considering getting a student visa and continuing her education in Canada. If she does this will it mean I automatically get a visa? Will I be able to attend public high school with this? Just until my father gets nominated atleast.
 
There is never a guarantee for anyone to get a visa. They could refuse your mother based on risk of overstay whether she applies for a visit visa or a student visa. They could refuse you for the same reasons, whether you apply with your mother or separately. You should actually be applying for a student visa too if your intent is to study.
