Hi I became Canada PR in March 2014 and stayed in CANADA for 1 and half month and came back to USA on H1 visa and never been to canada, but due to some reasons I want to go and settle there but as I landed in Canada in March 2014 now it is Feb 2017 it is 1 month less than 3 years completed, to meet the requirement 2 years out of 5 years I have 1 months 20 days exactly. And I never received my PR card till now, I am just 15 miles away from Canada, My questions here are ...

1) Can I go by my private car and Landing document with out PR card or PR Travel Document by private car?

2) And in this 2 years 1 months 15 days , do I have to completely stay in Canada to retain the PR status?

3) As I am on H1B, can I stay there and work every day here and go back by end of each day? make this fulfill the Canada requirement to retain the PR status?

4)Please tell me about NEXUS program applied to my case? as I have PR and Valid H1b with VISA as well

Please friends please help me answering this questions

You need to re-enter with your PR card. The landing document is single entry and you have used it already. You could probably say you lost your PR card and ask for a replacement.

You have to fulfill your obligation of being physically present in Canada. This means you can't exit and enter Canada everyday. You have to be in Canada for 24 hours to be counted as 1 day of physical presence.

Incorrect. It can be used to re-enter Canada via a US/Canada land border using a private vehicle.

It's also needed later in life - for example, when you apply for citizenship, pension, etc.

But the COPR says on the paper as water mark, NOT FOR RE-ENTRY, so that means we can not use for RE-ENTRY right? what to do with this situation? please help me , and guide me in right direction.

and One more question seniors please answer, I became PR in 2014 March 06 and spend 40 days and cam back to USA in 14th april 2014 so technically the PR status will end by 06 March 2019 March right? so meanwhile I have to make 2 years stay to retain the PR status am I correct? and If we calculate exactly On or after 15th April 2017 I am not allowed to Canada if I dont go now, is that true? please seniors I really need this clarification at your best knowledge ...

If the COPR says not for re-entry then it is obvious it was a single entry visa. you need to enter with a PR card. You would have to get a replacement for a fee. You have to be physically present in Canada for 730 to retain your status. You have already spend 40 days. You have to spend 690 days and you have time until 6 March 2019. Before you can go and live in Canada for 690 days, get a PR card and use it to enter. You cannot enter on any other visa (tourist, student, etc) as CIC has your details as being granted permanent residence.

Once again, it's 100% feasible to enter Canada using your COPR only via a US/Canada land border provided you use a private vehicle. This is an extremely well known fact and lots of people have done this successfully on this forum. Again 100% doable. If you're still in doubt, wander over to the Permanent Residency Obligation section of this forum where this is discussed on a regular basis.

If you are still not convinced then call CBSA and ask them : " I do not have PR card. Can I re-enter Canada on a private vehicle using my Passport and landing papers?". You can even drop them an email on this.

If CBSA reply does not convince you then apply for PRTD ( google it). This is a document PR holders use to re-enter Canada if they do not have PR card.

If still confused then hire a lawyer.

Wrong.

The PR card or PR TD are only travel documents, used to board commercial transport (like airplane) to Canada.

When crossing in private car at a land border, really all you need is a passport and nothing more. With just a passport CBSA can determine your PR status (might require a trip to secondary inspection) and allow you entry as a PR. With a COPR, it will be a lot quicker and easier for CBSA to confirm your status.

I have used CoPR to enter in to Canada from USA using a rental car which was 6 months after landing. CBSA "MIGHT" ask you some questions regarding your travel as well as your absence.

You landed as PR in Canada in March 2014 (lets say March 1), and stayed here 1.5 months (so assume you left April 15). This means you would need to return to Canada any time before April 15 in order to maintain your residency obligation. Basically after 3 years outside Canada during a 5 year span, you would be in violation of RO.

You should not wait until the last minute. If you want to maintain your PR status you should return as early as possible so in case there are any emergencies that require you to travel outside Canada again, you will not go over the 3 years outside in past 5.

As shown above, you can live in Canada and commute to work daily in the US, and that will count towards your RO. You should apply for a replacement PR card as soon as you arrive back, as it will make your life much easier traveling daily across the border. The PR card you will get will most likely have expiry date based on your initial landing (so would expire around 2019 or 2020).

Ignore all the posts from poster "xpressentry" as he doesn't know what he's talking about.
