Hi need some help so badly!!! I want to go back home in the philippines for a vacation this coming Christmas with my 5 month old baby girl but the problem is i dont know if I still need to get a letter from my previous employer as a proof that I had a valid work when i come back in canada but the question is I am in maternity leave till March 2013 do I still need a ltter from my previous employer? Since I have an OWP & a valid TRV multiple entry do I need any proof when I go back to Canada eventhough I am in maternity till next year of March?Do I need an OEC when I go back to the Philippines? what are the documents needed in applying an OEC? can I apply an OEC here the Philippine Consulate in Toronto? Pls pls help me. I greetly apprecite all the reply from this query of mine.

I was confused here on "previous employer" so to clarify - are you currently employed but just on maternity leave?

As long as you have a valid TRV (not expired), a valid OWP, you should be able to return back to Canada. It does not hurt to have a letter from your employer that specifies you are still an employee but on leave. Sometimes CBSA officers at the immigration counters ask to present the OWP.

You do not need an OEC to go back to the Philippines; this is an exit requirement.

Please check what your TRV indicates. If you have a "WORKER" on your TRV, most likely, on your flight back to Canada you will be identified at Philippine Immigration as a returning overseas worker. In that case, POEA rules will apply to you and you have to present an OEC at the airport on your return to Canada.

You can get also from the Philippines,POEA balik manggagawa or any POEA office close to your place or city.

I consider myself not employed anymore coz I'm planning not to return or go back to my previous employer as a caregiver since I have my OWP I am planning to find a new job when my maternity leave is over.

what if I can't get a letter from my previous employer? is it still possible that the CBSA won't require me to present one?

Technically, without a formal notice of termination of employment or resignation, you are still employed and the terms of your employment contract can still be enforced. Better make the separation from your employer clear. If you intend not to return to work for your current employer after your maternity leave, make sure this is done on good terms.

Did you previously have an OEC when you initially left the PH and started as a LIC? If you did then you can just renew that, but still you need a letter that you are currently employed or a copy of the employment contract. These are part of requirements to get an OEC. Unfortunately, the exit regulations in the PH require an OEC if your visa is a 'worker' class visa.

I mentioned in my reply that CBSA officers (on your return to Canada) sometimes requires to present your OWP (not the letter from your employer) - this is to check validity of your OWP.

yes I have an OEC when I initially left the PH but the problem is I can't find the copy of my OEC that the POLO given to me. Can I just go in the POLO Toronto & get an OEC & tell them that I need to renew an OEC even without the copy of the OEC that the POLO in PH initially given to me?

Perhaps you can give the POLO office a call and clarify this. I do not see the old OEC as part of the list of needed when you get a new OEC. A quick call to the POLO office may get you more information.
