CPC-M is required by law to lock in the age at the time the application is RECEIVED. This is from OP Manual 2:

The lock-in of age for dependent children is the day CPC-M receives a completed IMM 1344AE
and correct processing fees. Dependent children must be less than 22 years of age when the
sponsorship application is received.

Under 22 years means up to and including the last day before the dependent child's 22nd
birthday.
Offices must date-stamp application forms as soon as they are received.

As per OP Manual, Section 5.4, page 8 (http://www.cic.gc.ca/English/resources/manuals/op/op02-eng.pdf), "The lock-in of age for dependent children is the day CPC-M receives a completed IMM 1344AE and correct processing fees. Dependent children must be less than 22 years of age when the sponsorship application is received."

So as rjesssome said, your brother should be fine as long as you file before he turns 22 and he remains single. So tell him to behave while his application is processed.

Hey thanks,i got that link for op02 i saw this (If the requirement for
minimum necessary income is applicable, sponsors must demonstrate that they can support all
family members, including non-accompanying family members.
i m dumbfounded,I am sponsoring my parents and but i have 2 more brothers and 2 more sisters all over 22 except
my youngest brother he is 21. but do i really need to show proof of income even for other non-accompanying siblings that are not classed as dependable child?that would be too much to income to provide me and my wife made enough money to support my parents and my 21 brother but not for the rest ,Have you guys heard of anything like this,Wow immigration is so deep Nice weekend guys

No, you don't have to show enough income to support family members that are not included in the application (non-accompanying because they don't meet the requirements).
