Hi guys :)

First, I'll give you some background:

My hubby has a refugee status here in Canada(I am a Canadian Citizen). He received a deportation date back in September 2012. We got married right away and appealed it. In October 2012, we sent out our sponsorship(inside Canada sponsorship). The reason for appealing was to buy us some time for the sponsorship to come through around the same time.

Just this week, his appeal was denied. My heart dropped. Now, I am so distraught. :(

What happens now? We keep checking the status of our sponsorship and it's still in 'process'. It's been 6 months since we sent it out.

I have a couple of questions.

How long did it take for the sponsorship to be approve? (I know it's said 8-12 months, however, I'd like to know from personal experience).

What can be done now, that, his refugee status is denied(we cannot appeal, that was the final appeal) although we still have a sponsorship in process? I can't bare to have him deported and never come back.

ANY kind of insight/advice/ANYTHING would be very much appreciated. =)

Sorry to hear about your situation,I too was denied PRRA in November but my rejection was administratively stayed by CBSA pending my sponsorship outcome which they asked me to apply for at that time,I was very lucky and am extremely grateful!-Hopefully they'll do the same for you especially since you've already applied!-I really wish you all the best.

Did you apply to CBSA at the same time you sent off your sponsorship, or was that after you were denied?

What would you suggest we do now? Should we wait to hear from CIC regarding his denied appeal(so far, we just got a letter from Federal Court saying it was rejected) or should we go and ask for it asap?
 
I think you guys are doing yourselves more harm than good, because you mentioned you married him right away after he was ordered deported, and even if you guys apply through sponsorship, it's going to be an uphill battle, because you guys married right away after he was ordered deported, and because your husband himself, is a rejected refugee applicant. The visa officer will likely reject your application because of that. If I were you, instead of waiting a year for your sponsorship to be rejected again, ask your husband to take up a skilled trade or profession under our Federal Skilled worker program. I could be wrong, but I believe by applying for Skilled worker class, the visa office won't care about him being previously deported.
 
maybe i could help as well mirembo was correct, so i would advice to wait dont shake any ruffles since u was denied cic will contact u within umm i think 9 months time, and depends on the officer he will notice u have an application inland and he will let you remain and not have you deported, he will also check your application to see were it is at and sometimes he might even give u a temporary residency, i forgot what they called it, but just wait am sure u will be ok and keep your fingers cross.

well even if hee got married right after he applied, all that means is he would have be interviewed to see if his relationship is genuine, and am not sure but when did u send the application, if u sent it after september 24th then will be given a temporary residency and have to prove yur marriage in 2 yrs, if not u will stil be given an interview becasue that is a red flag

Sorry, I'm a bit confused. So since his refugee status was appealed and denied, they will be contacting us within 9 months? or were you referring about the sponsorship contacting us within 9 months?

It's about 5-6 months into the sponsorship since we filed.

And our relationship is very genuine. We live together, my dad adores him, everyone has met him, we are starting out our future together, I can go on and on.

We sent a huuuuuuuuuuge load to CIC to show them the genuinity of our relationship. Loads of photos, receipts, a thick pile of text messages, joint account info and usage, address change/license/car ownership/health card changes/bank changes, we filed taxes together, letters from friends and family, etc. We also sent more additional information 3 months later to show them MORE proof that our relationship is REAL and is ONGOING. And we did send it originally after the 24th of Sept. 2012. How does that changes things?

I will do anything in my power to fight for this. I just need options on what can be done and the right away to go about it.

Interview? Bring it on. I will do anything and everything.

He has a career going here and he has education. He works at trained skilled profession and pays taxes, etc. We are both educated people.

And you didn't read it right, our sponsorship was not rejected, this is the one and only sponsorship that we have ever had going, therefore we will not be waiting another year for our sponsorship to be rejected 'again'. What did you mean by that?

No offense, but I don't need any kind of negativity right now, I have a lot to do deal with as is right now outside of this situation, a death and a national designation exams.

You are so right my dear. When you are dealing with issues that affecting your life negativity is not appreciated because instead of giving you hope it discourages you to continue fighting.
You should take the comments and opinions of the people who gave you their experience and combine them with your wits and determination in order to win this.

i believe that CIC has officers who are not robots and they will, after procedural examination of your sponsorship also check the human side of this as well

oh i meant they will contact you in 9 month time but before that you should get a letter getting ready for deportation as long as all your appeals have worn out, but like i said if you reach to the point were the officer is ready to deport you, two things can be done, the officer will notice you have a sponsorship application and will grant you to stay until the decision is made, the second thing is you can go to a councellor and they can allow you to stay under human and compassionate grounds.

i would wait till they send you that letter am very sure the officer will just let you stay until your application is done, so no need to worry just live love and enjoy yourll life nobody is gonna take it away from you all

No I didn't apply,they called me in their office to let me know that my PRRA had been rejected and what would be happening,I had applied in 2006 so it took more than six years!-Since I had not applied for sponsorship they gave me a week to do so and informed me they would be waiting for the outcome which would determine the next step!!-I figure they'll call your husband to talk about his options!I suggest you go with him.-Sending positive vibes your way :)

You're the sweetest! Thank you for your positive comments :) that's exactly what I'm doing.

Oh god, I sure hope so. I have never dealt with CIC before so all of this is all new to me. Definitely don't know what to expect.

That is good to know, that we do have options and what they are. I hope they will be lenient in exercising them. I'm not used to having no control like this, so totally operating in fear-mode at this moment. However, I feel more positive about this then I did before after reading what you guys have to say based on your personal experiences dealing with CIC.

Our sponsorship was received on Oct 19, 2012, and started processing December 20, 2012. However, they didn't start to process his PR application that was sent out with the sponsorship yet.
