Newbie here and hoping I can get some help. We are in the process of collecting all docs and form IMM5604. We have no issues with getting my husbands ex to sign this to allow my stepson to accompany him to Canada,however my question is the checklist also states that if divorced or separated we must include custody papers.
My husband was never married to his ex nor did they live together, they share a child who has lived with him since 3 weeks old. I am at a loss of what to do. Should I send him to the courts in the Dominican Republic to get custody papers or will IMM5604 signed and notarized along with a letter be enough.

The wording states: IF you are divorced or separated...".

As he is neither, he has no court papers to submit. The signed IMM5604 is sufficient.
 
Thank you, this is where I got confused, as I have heard so many different opinions. I am doing this myself and the forum has been super helpful. I would be interested to hear other experiences as well

they have asked for divorce certificates from my husband and his baby mother (they were never married either) and require custody papers from the courts -- we are doing this from the DR as well. I would be safer than sorry and get it done.
 
Yes I think we are just going to go ahead and get the paperwork. If you don't mind me asking how long did it take you to get the custody papers and the approx cost. Did you have a lawyer do it all. I'm not comfortable with the process down there and I leave it all up to my husband as he can navigate better than me with those offices. I know we need a bunch of other things from the Dominican Government but I think we will wait on that until we get further in the process. At this point I am not submitting until at least October/Nov

He already had the papers since his son was a year old so i cant say. His son is almost 5 now

I dont see an issue getting this done, I think you are right to be prepared and get the papers drawn up. Better safe than sorry, and hey he will need these regardless when he arrives for school, and everything else.

Agree. We started getting our stuff ready in september. Come february when we got married we were able to send everything. We are now just waiting for the passport request. Best of luck in your process!
