Hi everyone, anybody might have an experience or expertise with this. This might not be the right category for this,but I also posted it here and on the worker site just to receive more thoughts and comments.
My situation is, I came to Canada on a work visa for 2 years, I got married to a Canadian last year, submitted an inland spousal application dec 2010 before the work visa expired, got a 6-month visitor visa good until June 2011. Now, I found an employer with positive LMO. I submitted an application for work visa in Vegreville 2 weeks ago. Called the call center today, she said it will be possibly denied since I was on visitor visa and I should be applying outside canada visa office instead at Vegreville. I withdrew the application for my work visa now. I am so confused. Is the agent right? Should I be applying outside Canada? (I looked at Manila time line, OMG 15 months, I will have my AIP then). Is there any other visa office I could apply? Please help. Thanks.
 
You have to apply from your country of origin, from where you hold a passport.
Otherwise you should be a legal resident of another country for more than ONE year, to apply from that country.
 
You could go to the border, but you are from the Philippines if I am correct, you need a visa to stay in Canada- so that`s not an option for you.

Wilson, if she is staying in Canada legally for more than a year can she apply through Buffalo?

Hi Wilson, the agent told me that I could apply in Buffalo but I should be also prepared for an interview (if needed), so I should get a visitor visa in the states. But also I am concern that our INLAND spousal application might be affected if I go outside Canada.

Yes Ditta you are correct. I am from the Philippines. I am also worried if an interview will be needed in Manila, I would have to go out Canada.

Not true. To apply for a work permit (or another TEMPORARY status permit), they just need to have been legally admitted to the country where they are applying from. To apply for PR, you need to have been legally admitted for at least one year, not lived there for a year.

My husband was here on a visitor visa and got a work visa while in Canada (from Portugal). He flagpoled the first time, then applied through Vegreville to extend it the second time. I think you should just leave your work visa application in process. See what happens? The call center person may be wrong

Because he flagpoled the first time it means that he applied for the WP "upon entering" Canada. Then he could apply for the extension to the WP from inside. She needs to apply outside of Canada if she is here as a visitor.
