Well I am desparately looking for information:
I am in a very sticky situation in which we stupidly messed up. I have been married to my husband for 2 years and we recently had out first baby. My husband has been living in Canada 5+ years and 2 of those years have passed that he overstayed his time and was issued a deportation notice and failed to leave. So he is of course considered 'illegal' here. Our plans were to have to leave to go back home and I would sponsor him and he should be back within the year but we were told this won't happen as he would be grilled at the overseas office and he would have to apply for a Temporary residents Permit (Ministers Permit?)?? and there was a good chance he wouldn't get it or it would take years. So we don't know what to do?? We were under the assumption that I would be able to sponsor him overseas, rather quickly compared to in canada, and now thats not the case. A lawyer told him to apply for Humanitarian and Compassionate grounds but I believe this is not possible as we are married and I believe I would have to file an INLAND sponsorship application.
We are feeling sooo helpless as we have a newborn baby, a few weeks old and our original plans are not possible.
Anybody have any advice? If we leave Canada to go back to his country then I will lose my job and there is a change (we've been told) that he may never get a TRP (ministers permit) or it will take many many years.
I want to raise my baby in Canada and want my husband beside me :-(....*I WAS BORN HERE IN CANADA SO I'M A CANADIAN CITIZEN BY BIRTH*
My husband was given a deportation date and never left...we stupidly thought he could go back home and I would sponsor him from there and he would wait....now we're being told that will take YEARS and we feel helpless as we have our newborn and I have a very good permanent job here...
ANY IDEAS as to what he could do in canada? or if he should leave? will he ever be able to come back here to canada with us?
