My Friend and her Wife Entered Canada, without informing about their new born baby 2.5 years back. The Baby was born after they got Immigration VISA,

its been 2.5 years they are staying in Canada on PR, they got separated also, because of fight in between them,

Yesterday my Friend got call from Citizenship & Immigration department, He was worried, I was thinking since it is the case of misrepresentation...

what will be the consequences of the same???

Fine??

Please advise, him , don't know what was in the letter for him...

:( :-[

Where is the child now? Is it in Canada illegally?

You asked for advice on this forum back in 2011 and Leon correctly informed you that you had to add your new baby to your application before landing - and that you could no longer use the visas that had been issued to you. Unfortunately it looks like you ignored this advice and landed anyway. The consequences for these actions are: (1) you and your wife both committed misrepresentation which could result in having your PR status revoked and being asked to leave Canada; (2) your baby can never be sponsored for PR because you failed to declare your child prior to landing. I know it's too late - but you should have followed Leon's advice.

nagra007,

How did he got a call from CIC? How did the CIC become aware?

My bet is that his wife (who he is separated from) submitted an application to obtain PR status for the child and this is how the misrepresentation was discovered. But that's just my guess...

What she can do now, one of my relative was in same situation but luckily his doctor informed him of this consequence and he reported his baby waited for another six months in home country for re-medical of his wife and kid and now they are here. But naturally his motive at that time was also to get in the family ASAP, now think he was luckily stopped.

Unfortunately there is nothing they can do now except to wait for what will happen. Immigration could revoke their PR's because of their case of misrepresentation.

Some people seem to think that it will speed up their process to not include a child or a spouse and that they would be able to sponsor them later but this is wrong. Immigration is very clear on that. If your family composition changes between applying and landing as a PR, you are obligated to inform them and add any new family members to your application. If you do not do this, your visa is based on the false information and that is seen as misrepresentation. If you have committed misrepresentation and immigration finds out about that, your PR can be revoked but in any case, you would never be allowed to sponsor the family member you did not add to your application.
