hello everyone this is my first post.

I would like to describe my wife's situation to you. She was in Canada as a refugee for 2 years and 9 months! I am a Born Canadian citizen who married my wife in Toronto Ontario while she was here. On May 31st she was rejected status in Canada as a refugee, her pre-removal risk assesments were also rejected due to lack of proof and was asked to "voluntarily leave" Canada. In the dominican Republic she was beaten and raped by a very politically influenced man who controls alot of the authorities in the Dominican. He had beaten and raped and confined her for many years before she eventually escaped with the help of another person. This man is actively hunting for her. In May when it came time for her to leave Canada i couldnt let her face death alone so i left Canada to join her on the same flight to Dominican Republic. We stayed in hiding for 8 days and didnt even come out of the remote location i found. I changed her appearance to ensure her safety. We ran all around the Dominican to avoid being captured by this so called "man" after being smart and paying close attention to detail i managed to get her to another country. I have come back to Canada to try and see what i can do to get her back here in my arms. I dont have enough money to keep us afloat and will restart my employment this week. We have until December before she will have to leave the country she is in and return to the Dominican Republic. I am trying to do the sponsorship on my own as i cannot afford a lawyer. Any adivce on what i can do to get her here while i sponsor her? I fear that in December she will have to go back and I will follow her. I need my wife back and our lives back! please help us with any advice possible!

I hope someone will have some constructive advice for you. I have no experience with this at all, but I think a situation like this, where refugee status has already been refused, is beyond the scope of the Forum and you need to find a way to get good legal immigration advice. Can you contact agencies that assist women in distress like Women Against Violence Against Women in Canada. Are there women's agencies in DR or the country your wife is currently in? Good luck.

This is a tough one and I agree with Pippin you probably need some solid legal advice on this one. Or have you considered you both settling in another country?
 
The most you can do is submit an outland application to sponsor her ASAP.

Given she is a failed refugee claimant, I think it's going to be impossible to get her here while the application is being process. I suppose you can try applying for a TRV to see what happens. But expect a refusal.

This may sound a bit weird and I have no idea how this wold work. I am an American thinking of moving my family there. That being said, I know how a little bit of this works on the American side. How close do you Live to New York? I know this sounds down and dirty, but have her claim refugee status in NY to buy you some time. If she is in NY that would keep her from having to go back and at the same time keeping her close to you while all of this is worked out in Canada. Or maybe her visiting here for a few months in NY and setting her up with a cheap efficency apartment right over the border for a few months while she stays as a visitor. You might be able to even run her down to an American embassy there in CA and explain and they may help there in CA. I hope things work out for you guys and esp for her safty.
 
Firstly let me thank all of you for taking the time to respond! THANK YOU ! I have tried everything that you guys can imagine, I have gone to the women's groups here in Canada, Prime Minister Of Canada, Jason Kenney who is our Minister of immigration, various catholic organizations, Amnesty International, And United Nations. The prime minister wrote back and forwarded my emails to Jason Kenney but he has not got back to me even after i flooded his inbox. From what i hear, we have the toughest minister in our history. If my wife claims refugee status in America she will most likely be denied due to her rejection in Canada. I have considered settling down somewhere else but its very easy for Canadians to settle somewhere else but not for her. I am going to put forward the application once i can raise enough money, as you all can appreciate i have spent my last dollar to protect her, the next plan is to go back to work raise enough money and maybe go hide in her country in December and pray to God that we will make it past 30. I will not give up and will continue to check resources.

P.s In my wifes country, just the capitol city, from jan to may 284 women died at the hands of their partners its an outbreak

p.p.s I aslo applied for a job at the Canada Border Services Agency
 
Amnesty and United Nations said clearly, that if my wife was denied status in Canada then they cannot do anything for her.

What kills me is that im Canadian Born who escaped from Congo when i was 11 and came back home. Today when i need help the most my Country men have abandoned me. My wife established her own business while she was here and payed all her taxes. My next door neighbour came to this Country on a lie and today he lives in peace on welfare while a Canadian man struggles to live. I want to join the army and take up immigration law if we make it out of this. If your life is not in danger please do not lie to come here as people like my wife now suffer because of it.
 
The very first thing you should do is file an outland spousal sponsorship application.

By all means pursue other avenues - but do this first to get the ball rolling on obtaining her PR status through family class.
 
On the contrary, I will suggest you trying to settling to another country and then file an outland sponsorship application for her to come to Canada as PR.
 
There are endless places u could take her in the Caribbean to hide out. Once she is safe then apply yourself to sponsoring her as your wife. If your case is genuine then that's my advice. If its not then ....................................
 
Agreed! I shall file the sponsorship papers as soon as i raise the money. As for doing it myself, i have been advised and thru my research it seems her case will be difficult due to her being kicked out of Canada so that being said ,I must hire a good lawyer and they cost alot. I havr put evrrything I have up for sale we shall see when that money starts to roll in. I am trying to find a place to keep her while sponsorship takes place. In the carribean they are only offering a 90 days entry to dominicans. Once again thank you and i agree with starting the process a.s.a.p. I shall keep this thread updated and we could use some prayers devine intervention is needed. Thank you all once again
 
I have a hard time following: in May she was asked to leave and you both left for the Dominican Republic.
Some 8 days later, both of you returned to Canada. If she was asked to leave Canada, why would the immigration officer let her back in 8 days later?
If she was let in, then she must have some sort of status here.

She hasn't returned to Canada since being ordered to leave. She went to a third country and is in hiding there.
