Help! Expired Visa and don't know what to do???

When I was 16 I came to visit my father on vacation. After a couple of weeks my Dad asked if I wanted to live with him, I said Yes. My Dad told me for 2 years that my immigration was taken care of and I never worried about it until I started looking for a job and discovered I didn't have a sin number. I kinda just brushed it off being a teenager. Over the years I had travelled back and forth from England (which is were I originally moved from). I am a British Citizen. One time when coming into the country I was stopped and issued a Visa. As time went by my Visa expired and me being 17 was oblivious to this as i thought my dad would take care of it. He didn't and when I was looking into becoming a permeant residence I needed a Visa. Then I discovered my Visa had expired and I am finding myself in a difficult situation. I looked online and discovered that the time to re-apply had passed and i couldn't apply for a new one within the country. I am suck on what to do as I would like to stay here. My father isn't really much help and now that I am 18 he believes I should take care of it alone. If anyone has a solution i would greatly appreciate it. Thank You . Hattie

You'll need to provide more information in order for us to help you. When you say 'visa' - what do you mean by that? What kind of visa? What was your status in Canada previously? Were you just here as a visitor? Did your father get permanent residency for you? Unfortunately we can't help without further information.

It was a Visitors Visa and I haven't had status since I've lived here accept the 6 months i had a visitor visa for. My dad didn't get PR for me no

So you were basically living in Canada illegally. You can't keep doing that or you'll end up having issues being allowed to return and may even be banned from returning for a year.

If you want to be able to visit Canada, you need to apply for an eTA. Keep mind this only allows you to VISIT - not live here. This means you should be spending more time outside of Canada than inside of Canada each year. While here as a visitor, you cannot study or work.

If you want to be able to live in Canada, your options are pretty limited given your age. You could look into getting a study permit. However this is an expensive option and you'll need to show you have at least $25K in the bank just to be approved. You could look into the working holiday visa program (IEC) - spots are limited and in very high demand. If your father is a citizen or PR - then he might be able to sponsor you. That's about it.

It is visitor status, not a visitor visa. If you have been here longer than 6 months and your visitor status wasn't extended, you are currently in Canada illegally.

Assuming your dad is a Canadian citizen or PR, he would need to sponsor you for PR.

Yes he recently became a citizen and I was looking into him sponsoring me. But like i said He has no interest in it. I was wondering if there is anyway at all I can get a new Visa.

In that case your options are extremely limited and you're definitely here illegally. Hopefully you're not studying or working since that will make it even worse.

Your only option is for your father to sponsor you for PR if he himself is a PR or citizen. Otherwise it's impossible for you to fix your status from within Canada. You have no option other than to leave. Unfortunately you've been here illegally for too long.

Without your father sponsoring you - you have to leave Canada. Impossible to fix your status from within Canada. Again, you've been here illegally for far too long.

Once you return home, I would recommend you remain in the UK for a while before attempting to return - at least six months.

I have been going to high school yes. I ve tried applying for a PR but i thought i needed a Visa?
OK - so then you're also studying illegally. That's not good.

You cannot apply for PR on your own - you don't qualify. The only option is for your father to sponsor you.

i know i can't apply on my own. but i was told that i need a Visa to apply for my PR whilst my dad is sponsoring me... Is this correct?

I'm not sure what you mean by a visa. If you mean legal status in Canada, then again, it's too late to restore your legal status from within Canada. You've been here too long illegally. You can only restore your status by leaving Canada.
