I've been dating my Canadian boyfriend for about a year and a half now. I'm looking to make a move to Canada when he returns to Canada, but I had a few questions about him sponsoring me.

1. If I get the sponsorship visa, does this qualify me to work as well, or do I need to obtain another permit / work visa on top of the sponsorship visa?

2. What kind of 'proof' is needed to prove that we are in a relationship. I'd assume pictures, chats, letters, letters from friends are all good? How much is usually needed?

3. While we have been 'together' for a year and a half, we haven't been able to live together for a year due to visa issues / contractual obligations. I know this excludes us from having a common-law sponsorship visa. However, could he still sponsor me for a conjugal visa?

4. I'm not allowed to have any government money used on me, I know. But does this extend to health care as well?

Thank you. :D

1) Yes - you will be able to work.

2) Yes - all of the things you have mentioned. Also shared mortgages, shared rental agreements, insurance policies, proof of travel together and travel to visit each other, emails, joint bills, etc. Include more rather than less.

3) Where are you from? Are there any barriers preventing you from getting married or living common law? (Example of barriers would be that neither of you are allowed to travel to each other's country.) If there aren't any significant barriers then conjugal isn't going to fly. In you're from the US or the UK, for example, then it's extremely unlikely conjugal will work.

4) You will have access to health care.

I'm from the US, however, we met in Japan. Our contract stated that we were not allowed to move houses, so we could not move in together. My contract for Japan ended August 2010, so I had to return to the US. He is contractually obligated to stay in Japan until August 2011. So, while I can visit Japan to see him, I can't live over there.

Is there anything preventing you from getting married? (I'm assuming there would be nothing stopping you from marrying him on a trip to Japan or him marrying you on a short trip here.) This is the challenge you're going to face when making your case to the CIC. From their standpoint, there's a good chance they won't believe you're facing 'significant barriers'.

Conjugal is typically reserved for situations like the following: Couple is same sex. Non Canadian partner cannot get a visa to visit Canada. Canadian partner can go for a short visit but same sex marriage in the partner's country is prohibited. Non Canadian partner cannot obtain visit visa to any other country that allows same same marriage. In this case, it's literally impossible for them to marry or live together anywhere for one full year.

I'm not saying you shouldn't give conjugal a go. However be prepared for the fact that it's going to be a lot of work (you'll have to supply more supporting documentation than you would for the other two classes) and there's a higher chance your application will be rejected.

Hope this helps! Good luck with whatever decision you make.
