Hi All

I applied for PR in May end and got AOR July. I haven't received MR yet. My work permit will Expire in Feb 2013.

I confirmed with my employer and they refused for LMO.

Do I have to leave Canada once my work permit is Expired?

Is there any option to extend work permit?

Please help.....
 
I'm in the same boat as you. :-[ It's very common for alot of employers not to want to do LMO for foreign workers as they feel it's too much hassle.

If you are from a visa-exempt country, you could go somewhere like the States for a trip, and then come back to Canada - but then you will be on a visitor status (which means you can stay for a maximum of 6 months at a stretch). However, during this 6 months, you cannot work.. but you can remain in Canada.

Do note that even after your WP expires, you have upto 90 days to pursue status restoration from within Canada - either as a visitor or a worker. So there is no need to leave the country immediately after WP expiry, which gives you time to look for a new employer who can get an LMO for you. Even otherwise, you can try to stay as a visitor as suggetsed by shells. If you do not apply for status restoration within 90 days, you have to leave the country.

It is possible that you may get your MR before Feb 2013 and have your complete PR processing done by March/April 2013. A good number of applicants get it done within 8-10 months. But that you never know!

When you said "refused for LMO", do you mean that they tried applying, but got refused. Or do you mean, they refused to apply LMO for you?

Is your current work permit a closed work permit for this specific employer, or is it a post-graduate work permit? If it's a pgwp, then you are not allowed to change your conditions (the only one way you can stay is, if you can successfully apply for an LMO and get a brand new work permit).

As far as your CEC application goes, Medical Request (or even PPR) DOES NOT give you eliglbility to work. It does not give you Implied Status. You can work only when you land as a Permanent Resident after your PR processing is completed.

You get Implied Status if you apply for Work Permit extension before your current WP expires. For this you need an LMO. If not, then you lose your worker status with the expiry of WP and cannot work until CIC issues you a new WP.

Raj, good news - CIC just announced a new "bridging open work permit" for CEC applicants (and others) who have received their AOR... No LMO necessary, its not employer dependent !

You got an option of Open work permit now.

I sent my application in June and got an AOR in July. Was this the letter I received saying my application was complete and being sent out to a visa office for processing. It did not specify my visa office. I still haven't gotten a request for medicals. I applied under CEC graduate. Should I be worried? its been about 7 months.

The average processing time is 13 months so no, you shouldn't be worried. Where is your home country?

Hi Duerre,

I don't think you need to worry much about that. Are you checking on the timelines of others who applied at the same time as you, have any of them gotten their MR yet? If not, most likely they are still processing it. If you are very concerned, you can order CAIPS notes (free if you are currently in Canada). You an find more information at http://www.canadavisa.com/canada-immigration-discussion-board/how-to-order-caips-notes-t72568.0.html You can do that by yourself, it's a very simple form to fill.

Also, if you haven't landed by May yet (seeing that your PGWP expires in August), you should consider applying for the Bridging Open Work Permit. You can only apply for that within 4 months of your PGWP expiration. It is too early now to do this.

Hi Raj,

Just go through the link that Jes_On has provided, and you donot need to worry abt the work permit part. But, if your employer is terminating your employment for some reason, you probably need to look for another employer. Since, the new permit that u will receive on the basis of your AOR would be open in nature, you can work with a different employer. All the best!!
