Haven't filed taxes-explanatory letter or file, and wait for Option C Printout?

Hi,
My husband (Canadian citizen and planning on sponsoring me) worked in Canada during the last elections (he was a poll booth officer) and for a university. He has not submitted his tax forms yet, and thus cannot access a Option C Printout as they don't have one for him. Should he state in a letter that he hasn't filed his taxes yet and therefore doesn't have the Option C Printout even though he will have to state he has worked in Canada within the last 5 years? Or should we try to get an Option C Printout (which would be difficult, because the forms he has to fill out for his taxes are in Canada and he's residing in Paraguay)?

We're not sure what to do in this situation! It would be great if we could just send a letter in lieu of the printout, but the fact that he hasn't filed his taxes (instead of not having worked) might look bad.

Alternatively, could we just say in the letter that he just recently filed his taxes but has to wait 4 months (that's how long it takes) until they're processed. So that is: file taxes --> submit application with letter stating he just filed his taxes. Not sure if that will work, or will have to wait for them to be processed, then request the printout.

For how long has he been residing in Paraguay now? When was the last year he worked in Canada? The reason why I'm asking is that Option C print out is requested by CIC only to prove that the person did not receive any social assistance (welfare) in the past year because that would make him ineligible to sponsor.
Also, for spousal sponsorship he doesn't need minimum income requirement. Is he working in Paraguay right now?

My husband hasn't worked in Canada since 2008 (he's been residing and working in Europe). We provided an Option C for the year 2008 and an explanation letter saying he's been filing taxes here for the past 5 years.

I'm not sure about this. Why do they want NOA for 2012? Do you need to meet minimum income requirements? Maybe other members can give you some advice on this.

I am PR sponsoring my child as PR from India, ND wants to get some details in that NOA is one of them. If they are following their book , ther is no min income requirements.

Thanks for your response! He has been residing in Paraguay for 6 months now. Before coming here, he spent 7 weeks in Montreal, and prior to that, he spent 10 months in Europe (mostly studying). Besides the 7 weeks in Montreal last summer, it's been a year and five months since he's resided in Quebec. The last time he worked in Canada was August 2011. He is working here now, though (since August 2012).

Perhaps the best path to take would be to send the application to CIC explaining the situation, and to try and have his tax forms sent to us so we can fill them in and send them back to be filed in the meantime?

Yes, you can file the application and write a letter explaining that you will provide the Option C later. Start working on getting that, and as soon as it arrives, then send it to CIC.

I guess there is nothing you can do, if you didn't work in Canada in 2012, then write a letter and explain to them why you don't have NOA for that year. Is is good if you can send the 2013 one too, along with the letter.

In this member's case they are just trying to determine if he in fact was residing in Canada in 2012 (NOA is one form of confirmation that someone was living and working in Canada), as a PR this member was not allowed to reside outside Canada while sponsoring a family member, as only Canadian Citizens are exempt from this requirement.

I submitted my application in Aug 2013 why do they need to check whether i a resident in 2012 or not. I am sending them copies of all pages of passport to prove that iam not resident in canada durin 2012. I think that should be enough for not submiting NOA for 2012.

You know, I was thinking about it, and it just doesn't make much sense they are asking for NOA 2012. But as you know visa officers sometimes send letters without editing them properly. But still get them all the other information you can.

If it's just for the last year they want to see, wouldn't it be fine to include a letter instead of Option-C if one has been living outside of Canada for some period of time?

I've been living outside the country for almost 3 years now, so I'm not going to include an option-C with my application. I have a letter from my employer showing how long I've been working there and how much I've been getting paid and a letter stating that since I've been living outside + haven't paid my taxes, I'm not including the Option-C.

You don't have to include Option C in your case, my husband did just to be safe. He just made a phone call and it was delivered to our address here in Germany within 10 days, so it didn't require much effort. He just wanted to include Option C from 2008 (last year he filed taxed in Canada) just to show that he acknowledged this requirement. But like I said, he explained he's been filing taxes here for the past 5 years. He included photocopies of his pays tubs for the year 2012 and 2013 and an explanation letter.

You should be fine without the Option C, because obviously you weren't getting any welfare in the past year. Also, it would be good if you included some pay stubs along with the letter from your employer.
