Hi,

I got PR Card 3 years back when I stayed over there for few months but I came back to India. Now I am planning to go there again but I got new passport after renewal and that passport doesn't have visa stamping even visa period got expired in my old passport too. My question/query with this forum is whether Indian government will allow me to fly for Canada as well as Candian government will allow me entry in that country.

I am so confused, please help me out in getting the answer of my this query. I will be highly obliged.

Your PR card is still valid so you will be able to at least fly to Canada. The question is if you are able to meet your residency requirements. You need to stay at least 2 years out of 5 in Canada. That means a maximum of 3 years out of Canada. Since you stayed a few months in Canada before you left, you may still be able to meet it if you come back to Canada soon and don't leave until you fulfill the needed days. You may have problems at immigration so you should bring some proof that you can still make your residency requirements to convince immigration officials to let you in.

What I understood is:

-- I can fly to Canada on the basis of valid PR Card nobody is going to stop me here in India at Airport as now Visa Stamping is no more required as I got the PR Card

-- Canada Government will also allow my entry in Canada because I have valid PR Card and Visa Stamping doesn't required now

-- To maintain the Permanent Residency status I have to stay there for total 2 years because I already spent few months hence I can minus those months out of total period of 2 years

Please let me know I understood everything correctly by your email or there is something lese.

I'm not that sure about exit control in India. All I know is that you need a valid passport and a valid PR card to board your flight to Canada. The last time I was in India, I didn't get a stamp in or out, but I had a multi-entry Indian visa in my passport. Since you have an Indian passport, it would be different for you. You will need to check with someone familiar with Indian border control

CBSA will let you into Canada not because you have a valid PR card, but because you have a valid PR card AND you can still fulfill your residency obligation. If you wait say another year to try to enter to Canada, you can be denied entry because it would be impossible to meet your residency obligation even though you may have a valid PR card. That is why I said that you need to return very soon. Once it has been a full 3 years that you have been outside of Canada, you will not be able to meet your residency obligation and CBSA can do the math and deny entry.

For your last point, yes it is two years. Since you stayed in Canada for a few months, those months do count.

Your PR card is your visa.. think this way... for you to fly out of India and enter Canada.. No one will ask for a visa on your passport.. but they'll ask for PR card
 
Your PR Card will also be helpful in easing transit visa requirements depending on your routing e.g. the UK exempts PR Card holders that are not transit visa waived from having a transit visa.
