Hi all,
A burning question... we've sent off the package for my partner's sponsorship (sent to Mississauga in Dec 2014).

I am hoping I'll get approved as sponsor in February, then his application goes ahead.

I know it can take 8-9 or more months depending on backlogs etc, for the sponsored person to get PR, but I have a potential business opportunity in Canada in August and I am wondering if we should take a punt and go for it, move back to Canada, with his application still in process?

I know it's risky - if he doesn't get PR and my business has taken off again it'd be a blow to leave it - so the question is has anyone else from the UK taken a punt and gone for it - then not got PR and if so, what happened next?

I also know every case is different - just want some perspective!

YOU can certainly move to canada, and he can certainly "visit" you while his application processes. your husband can't "move" to canada until he is approved for pr. Since he is visa exempt, he can enter as a visitor for 6 months and then extend his stay for the length of the application process if need be. Upon entry, CBSA may ask him to prove ties back to his home and will most likely want to see a return ticket.

Thanks I appreciate the reply - I did know this already and we are prepared to do it - my question is has anyone done this and had their partner's PR not approved, what did they do?

Its really a decision you have to make yourself. If someone was denied the PR then they can appeal but generally most on here would recommend not appealing as this can take years and a lot of money. Its generally better to fix whatever the issue was in the original app and apply again. If you are lucky and the PR app gets kept in Mississagua they are averaging 3-4 months for approval. In terms of remaining in Canada then if the application was denied your spouse could apply to extend his visitor visa so a denial wouldnt automatically mean he would have to leave Canada.

I can't recall any UK applicant who has been denied recently, some get asked for extra info and some have had issues with criminality but as long as your application is complete and you have checked and double checked then I wouldn't overly worry. Generally CIC will contact you if they have any issues and give you a time period to provide additional information. You probably will have more of an issue making sure he gets passed the CBSA...as rhcohen said make sure he has a return ticket that he can get a refund on once he's been granted entry.
 
Thank you Brucem - although what has happened for some people is no guarantee for others, as a betting person we'll have to see where we are at by May this year and make our decision there! I so miss Canada!
