Can a rejected refugee claimants apply for RAD appeal and H&C best interests of a child (BIOC) at the same time?

With RAD you can't however with JR you can if you apply H&C with RAD they will return it right away until rad finalize.

Thanks for your reply. I heard that if someone has kids would have an exception to apply for both together, RAD & H&C. It is not right?

Your H&C would be put on hold until JR is resolved.

someone who has kids can apply they are free from the 1-year bar. you can apply for H&C but after RAd but again with JR it will be on hold until your JR decision came out.. however after that, you can file prra for gaining time .. that is how it goes correct me if I am wrong in it @canuck78
