Asking for a friend. He wants to apply for H&C as he has reasonable grounds for it. His concern is few years later down the road his spouse might want to study something. So once you apply for H&C, do you become ineligible for a study permit?

Thread 'H&C Question- need help urgently'

Hi guys,

I have a friend who wants to apply for H&C(Humanitarian and Compassionate Considerations) together with his spouse.

Beside doing this application, few years later his spouse plans to enroll in school via applying for study permit and if she has a chance, she might want to try to apply for PNP and PR.

Will it be problematic in the future if in case his spouse gets PNP to apply also for PR? Is it a problem to have two applications at the same time, one being H&C and another a PR application via PNP.

As we know H&C has a long processing time, so the main concern is, are...

H&C is no longer a good option for 99% of cases because processing times are literally decades and there is a good chance there are going to have to be some significant reforms to the program. OP should be more concerned about how their friend’s spouse is going to remain in Canada since the VR may not be extended.

I contacted my lawyer regarding processing time, he forwarded me with Minister binder it says 600 months for h&c but unsure this is for eligibility review or stage two, 600=50 years
so right now I am 26 When our application is completed I will turn to 76 years old ! is this for real?

With current workforce and technology, perhaps for real. Who knows in the future if they would hire more staff and adopt A.I. to help the processing?

after 40 t0 50 years wow!
by the way I am nation of Thailand !

Well it is two years according to processing times so not sure where you get 40-50 years from. You are safe and since you cannot return to Thailand then you just wait. Assume you have Canadian children or children who you don't want to return to Thailand.

Depends on your urgency and country. As you can read, you don't come from a country for urgency and there are 49k in the queue with 1100 being processed this year. So you are safe and need H&C because you cannot return home. So It could take years if your case is not a priority. If your children or grandchildren are Canadian then they can continue in school and live in Canada. H&C is a PR pathway and not an alternative to economic pathways. Since you have chosen this path for a reason, you can stay and live in Canada.

H&C does not prevent removal so CBSA will likely try to remove those without status.

Yes that is actual current processing time given the backlog if you applied today. The program isn’t functional and needs reform. There are very large number of applicants and a very small quota allocated every year.

Not even 2 years for 2023 applicants these days. Most are waiting closer to 3 years just for AIP and then another year for PR. Also very little movement.

They are still processing 2023 applicants. The program is being examined for reforms since it is essentially no longer functional. What is your status in Canada?
