The good news - got the positive LMO, it took 3 weeks (Ontario).

The bad news - HRSDC made an error on the NOC. They put 4161 instead of 4165 (natural sciences vs health/social sciences, but occupation titles are similar).

Is this an important error? Will this cause problems with the TWP?

Did u ever found out what to do about this? I have the same issue...

my LMO was for NOC 4143 Pedagogical Advisor but they gave me smthg else(4131 i think). Now I applied for WP and they put another (third) one (4141) as Secondary School Teacher.

Hi - when I contacted HRSDC, they said that the two NOCs were similar (job duties were essentially the same, just a slightly different background/field), and not to worry about. The person I spoke with admitted she had made an error, but said once the LMO was issued, she couldn't change it, that we'd have to re-apply to change it, and as far as HRSDC was concerned, that was not necessary.

For the third LMO, they put the correct NOC. In any case, I had no problems with my CEC application.

As for your situation, I don't know if it is the same. It's not clear to me what happened - when you applied you put 4143, but HRSDC put 4131, and CIC put 4141? If CIC made an error on your work permit, I think that should be corrected.

Thank you for ur response... It really help! Actually, my LMO says "4141 - Pedagogical Advisor"
The issue is that 4141 is for Secondary School settings and I'm in a language school for adults aiming Public Servants. So, duties might be the same but there's indeed a difference of settings. Also, as I said earlier a WP was granted for Secondary School Teacher which corresponds to 4141, not Pedagogical Advisor

We applied for Pedagogical Advisor (4143) which promoted me from Language Professor (4131). I just got ePPR So, do u think I'd be ok not to be working in High School settings? According to CIC agents i can't and HRSDC told me to contact whoever did the LMO. I don't wanna waste my time but also would like the opportunity to make things right.

I think the problem is that NONE of the above are the correct NOC code... I think you should have been, and should still be 4131...

unless you are now considered an "administrator" or manager, in which case it might be

4143 is to counsel students, so that' s not right either. Technically, you are only authorized to do the job specified on a work permit, so ... technically, CIC is right, you are ONLY authorized to work in a secondary setting. (Still, your EMPLOYER is named on the LMO and the Work permit, correct?)

You say you just got the PPR, so here's my 2 cents - Now that you know you are not authorized to work, you should stop working until you land as a PR - and you should probably document that fact, that you stopped working as soon as you found out your work permit etc did not allow you to do your job. I think you will be OK in the long run with the PR, as long as CIC thinks it was an honest mistake and you acted appropriately as soon as you realized it.

You could try to get the new LMO, as more proof of your efforts to make it right - it may not be necessary and it may not come before you receive your PR visa, but if your employer is willing, it will show you are trying... just to be on the safest of sides...

You are absolutely right! Tx a bunch

4143 is to counsel students, so that' s not right either. Well I honestly didn't know another category existed Technically, you are only authorized to do the job specified on a work permit, so ... technically, CIC is right, you are ONLY authorized to work in a secondary setting. (Still, your EMPLOYER is named on the LMO and the Work permit, correct?)yes, u'r right! The name of the school is on both LMO & WP

I stopped working even if it hurts my budget. I rather do what's right. Now, I'll wait for PR to decide if I'd stay there. What proof can I send CIC. Will paystub suffice? It shows the hour I work normally and I usually get a monthly paystub. When I get PR and decide if I'm staying to work i'll send a letter to CIC to explain and provide them some docx to prove like u said.

The documentation is really "only if needed," it's just in case an IO asks you about it. If they don't, it's OK. Correspondence between you and your employer describing the situation and your decision to stop working until authorized would be useful. Hopefully, your employer is willing to wait a little bit and you can go back to work as soon as you are eligible.... Good luck!

thanks for your input. I have one question for u still that bugs me: can i file and get EI or something while i stop working

Eh... EI... good question. Possibly, but even if approved it will take a while. So it's been 10 days since you PPR, when did you send it? You should get it back soon, then you can land and go back to work..

yeah right u're probably right, I should simply wait and enjoy the time being.

I sent my PPT on Wednesday last week, but it arrived in Seattle on Friday. So, everyday I check the tracking# hopping it got activated... nothing yet!

Just thought of letting you know, I should get PPT back on Monday according to Fedex tracker... yehhhh!
Then will do my landing.

great! Happy Landing!
