Dear All,
I moved to Ontario on a closed work permit under the Global Skills Strategy program, and the work permit is valid until Jan 2021. Recently I completed one year in Canada and started the PR application under CEC express entry category. I am not clear what to answer on the question, "If I have a job offer in Canada?" under the "Intended work in Canada" section of the EE application. Since my job offer was LMIA exempted as per GSC (https://www.canada.ca/en/immigratio...reign/global-skills-strategy/eligibility.html). Would the answer be Yes (https://www.cic.gc.ca/english/helpcentre/answer.asp?qnum=1011&top=29)? I really appreciate any help you can provide.

You can say "yes". To claim the points, your employer needs to provide you with a letter stating they will continue to employ you in this role for one year after you become a PR.

  1. Could I say "NO" in that section, if I don't want the additional 50 points associated with the "valid job offer criteria"?
  2. If I say "YES" while filling the EE profile, and if I am unable to produce the letter from my employer stating "they will employ me at least for one year after I receive PR", then what could happen (is it either of the below,)?
    1. I won't get the additional 50 points, but I can continue my application with the current ITA if I meet the CRS cut-off for that draw?
    2. Or, I will have to cancel the current ITA, to go back to the express entry pool to wait for another ITA for the new score?

Calculate your CRS, if your points are high enough to get invited without the job offer points, then just say no. Remember, you’ll only be vetted based on what you claim on your profile. I’m in the same situation as you. I didn’t try to get the job offer points cause my score is already enough with just my work experience and it’s additional paper work anyways.

you can still edit your profile after getting ITA to remove the job offer. However your recalculated CRS should still be way above the minimum CRS in round that you got invited in. If it falls below, your application will get rejected.

the job offer has to be valid and must have all the requirements that IRCC is looking for. Some employers are not willing to provide such letter so depends on your employer.
