Get Visitor Visa of Canada and marriage

Hello Guys, I am From India, but right now In USA on F1 Visa... I got The Visitor Visa of Canada for three months. I got engaged to Canadian PR card. So I thinking that I migrate to Canada from USA and do court marriege In canada.. So, Can I stay In Canada after court marriege ?? If yes, then on what status it might be ?? Is it consider legally ??

You cannot "migrate" on a visitor's visa. It is used for visiting. If you and your fiancee wish to get married in Canada when you visit Canada, you may do so, ensure that you find out what paperwork is needed.

You cannot stay in Canada past the validity of your visa after getting married . Being married to a PR holder gives you no rights in that direction. Your spouse must apply to sponsor you for permanent residence, and she must remain in Canada while doing so because she is a PR holder herself. You will have to return to the US at the end of the time given to you by the immigration officer at the border.

If you were admitted to the US for a year, your application may be processed in Buffalo. Otherwise, it may be processed in New Delhi. Either office is very quick at processing applications in comparison to others. However, if an interview is needed and you select New Delhi, you will have to go there for the interview.

I believe your wife could apply for your PR through inland process once you get married in Canada. But this is a long process (prb abt 18 mnths), though I'm not a 100% sure, you may be able to work. You might want to check on that. But as Charlie suggessted, it is better to apply through Buffaloa or ND, this way it's much faster to get your PR.

An Open Work Permit (OWP) may be applied for along with PR if they choose the Inland route. However, it is not granted before first stage approval or "Approval In Principle" (AIP). AIP nowadays is taking as much as 8-10 months. He could be done with ND or Buffalo and land long before then if he applies Outland.

You can stay in Canada for the length of time given to you on the visitor visa (unless the border official gives you less when you enter Canada, which is unlikely). You will be a visitor, and it is perfectly legal. You can apply to extend your stay.
Once you are married your wife can apply to sponsor you. Outland is fastest, so I recommend that. That means the application is first sent to Mississauga (in Canada); then, if your wife is approved as a sponsor, they will send it to the visa office you choose to process it: either in your country of citizenship (New Delhi) or in Buffalo (but only if you were admitted to the USA on a visa good for one year or more). Make sure, if you choose Buffalo, that you will be able to get back in to the USA, because there is a good chance you will be called for an interview. If they call you for an interview, and you can't get back into the country for it, they will just refuse your visa. Applications processed through New Delhi are generally done more quickly than those through Buffalo.

Buffalo is currently showing 11 months. Still much faster than the overall Inland time though
