Hi There! I was in Canada as an asylum seeker and my application was rejected. I entered and finger printed in Canada on a fake name. After my case got rejected, I returned back to my country (volenteer departure) and It's been 10 years every since I left Canada and I was wondering if I could apply for permanent residency on my legal name. I had no criminal record, not even a parking violation ticket. I took volunteer departure. I would appreciate if you could let me know about my possibilities of getting permanent residency in Canada.

Which channel will you try to use this time for immigration?
Family sponsorship? Express Entry? Skilled Worker? Refugee?

Yes - you can apply for PR. When you apply, you need to be 100% honest about your immigration history and explain what you mention above. Since you were refused refugee status, you will most likely have to go through the ARC process to be approved.

I am thinking applying as a Skilled Worker. Thanks

Hi There! Thank you for your prompt response. Just a quick question, what is ARC? Thanks

What if I skip mentioning my previous stay in Canada and apply as a fresh applicant? Will they be able to figure out that I was there? If they do, will it be based solely on the fingerprints ? The reason why I am asking this is because my previous passport had all fake info (During my stay in Canada I have never violated any law, the reason why I am thinking about applying fresh is because after doing some heavy research, I found out that It is pretty difficult [if not impossible] to obtain an ARC) which was all different than my legal info. What do you think ?

If you're asking for help in committing immigration fraud, you will not get that help here. By lying on the forms, you will be committing fraud.

If you lie about your past your fraud will be discovered during the police certificate / security check / background check phase. You'll be refused for misrepresentation and banned from Canada for 5 years.

You did in fact commit a crime in Canada by entering on a fake name. You can't go back in time and fix this. Again, if you want any chance of a future in Canada, you need to be completely honest in your immigration application about your past history in Canada. Otherwise there's no point in applying.

Thanks for your advise. This is what I needed to know prior consulting to an immigration attorney. After returning back to my country completed my masters degree and worked on a job that has a high demand in Canada which led me to think about applying for PR in Canada. Thanks

No I am not lying to anyone. People think different ways, all I did was to put my thoughts into written form. Thanks for your advice though.

They will find out anyway, and then you'll be in real trouble. Any sort of omission, fact twisting, lying, alteration, "skip mentioning" like you said, is considered misrepresentation and is not good news for you.

Understood. Thanks for the advise.
