@Eagle333: I thought I would post this here (you can choose to share it or not), but I have found of late that ATIP seems to be ignoring their Service Delivery requirements. I have tried to contact them directly (email), and tried to contact them via my MP with little result. Very frustrating.

For those in the same situation, there is something you can do here. As they are violating (current) Privacy legislation, you can call their office to try to work out delivery of your notes. If that fails, you can submit a complaint to the Privacy Commission. Through this, they will (eventually) be ordered by a Justice to immediately provide the notes.

Here is the legislation (so you can quote what they are in violation of): http://laws-lois.justice.gc.ca/eng/acts/p-21/page-3.html#h-11

Here is the process:
- Visit: https://www.priv.gc.ca/en/report-a-concern/file-a-formal-privacy-complaint/file-a-complaint-about-a-federal-institution/file-a-complaint-under-the-privacy-act/ . It will tell you that you should try to work something out with the ATIP coordinator at the organisation you are trying to get notes from. But how, when you cannot call them? Well, here is a list of the ATIP coordinators: http://www.tbs-sct.gc.ca/hgw-cgf/oversight-surveillance/atip-aiprp/coord-eng.asp#I (note that IRCC is on that list, and there IS a phone number).

When you contact them, make sure you reference your ATIP request number, and request to speak to the ATIP coordinator. You can also signal that you plan to file a formal complaint with the Privacy commissioner.

- If this does not net results, then continue to step 3 on the above link, and file your complaint. Then there is a trace that the government will be held to account for what happened.

At the right corner of the GCMS notes, you will see the codes in certain pages

s. 15(1): Means SECURITY information has been withheld from PA, then CIC has protected that info with s. 15
s. 19(1): Means PERSONAL information has been withheld from PA. This information might have come from an ongoing investigation CIC was undertaking. Such information could have come for different reasons such as:

1) Sponsor sponsored a previous spouse then 3 years after the spouse entered Canada Sponsor divorced PA or PA divorced SPR. Now Sponsor starts a new application for a new PA that he/she just married. If your Sponsor had a similar case every time you get your GCMS Notes s.19 will be there to protect personal information of the previous case.

2) CIC mistakenly wrote information of a different applicant in your file. Since they cannot delete that information, all they need to do is to block that information with s.19(1) so that you do read that.

3) Sponsor's Citizenship has enough ground to be revoked, s. 19(1) will protect that information from both PA or SPR.

I can go on and on... just to give you an idea what you asked.

Thank you so much for replying. I am the sponsor and first marriage (married for 5 years now). However, I used to live in Europe 2 years ago. One other question, on the GCMS notes, the paper file was transferred to another officer in VO. I searched the name and it turned out to be the Counselor of the embassy. Since August, they keep on responding to my queries that file is pending final review and decision. Do Counselors also make decisions on the file? My case is not straight forward one. I have sent you a personal message I believe a few months back. I can send you more details to your inbox if it's okay with you.

No codes for me , I believe because there is no restricted Notes .

ATIP were pretty consistent in sending out GCMS notes within 30 days until they changed the consent form.

I got mines about 100 days late. I requested another one it better not be another 100 days lol or I'll be submitting a formal complaint.

I already used my MP as a lever and got no where. So I submitted a complaint after they refused to return my call.
 
My hubby sent a GCMS request to ATIP, and has not paid the $5 fee. I wonder if he will get enough info out me as the principal applicant. He is a Canadian citizen and sponsor. He couldn't find where to pay the money and he also forgot to date the form. Will it be rejected because of that or should we submit a new form and pay the $5? Any reply will be greatly appreciated. Cheers

He better use the same tracking number ATIP sent when he submitted GCMS Request otherwise His application will be considered as a new one.

Hey guys, I received my GCMS notes and was wondering if anyone has an idea where we stand on security and criminality.

For Security it says:

ADMISSIBILITIES
SECURITY 1
UCI#...
Family Name...
Given Name...
Type: Security

with sub activity:1

and on the right there is S.15(1).

Does this mean then that we passed security, based on the first post in this thread?

For Criminality the status is IN PROGRESS and subactivity says "No Reportable Trace" for RCMP screening.

But then under Police Certificates it says 0, even though we did submit a certificate with the application. Does this mean that criminality is complete except for the certificate? And does it mean they need a certificate or just that they havent reviewed the one we submitted yet?
 
I went thru the entire website to find out where and how to pay the $5 fee for the GCMS note, unfortunately no luck just yet. Another question. My hubby isn't very good with forms. Can I use his info to fill in the form and submit it on his behalf? Like I said before he has submitted the form yesterday but did not date it and has not pay the fee since he couldn't find away to pay it. I'm so concern that we will wait for a month and won't get any response from the IRRC. I'm so frustrating with the whole situation as it is now. He can't get a visa for Australia and no info since our file was sent to Sydney two and a half months ago. Please any step by step explanation would help.

Choose the country you are paying from. Pick Access to Information Request for what you are paying for.
 
Thank you Profiler for the link you've sent me. It so much easier now. Do you know if there is also a possibility to upload the signed GCMS form on the same page where we can do the payment? My final question again is, can I use my hubby's info to complete the online version because I can't see my hubby complete it correctly due to his tremendous dislike for complicated government forms. He keeps telling me to request the note on his behalf but I'm not sure if it is allowed if I use his info and payment method? If you can please help me clarify the above questions, I will thank you forever.

You submit that form, when you are completing the ATIP request. If you didn't submit the form during the ATIP request, then they will ask for it and you can send it via email.
