Hi Fellow Forum members and Experts

My situation now in Canada, am not resident as I am H1B job worker in US and my family settled in Canada and started visiting every weekend.

I have already passed 2 years and in 3 rd year and my family completed 3 months and received OHIP cards for all of us.

What is the use of days visited to Canada by myself during weekends or any occasion? Will these be accumulated and accounted to calculate the eligible days for PR renewal?

What is status of my family, if I loose my eligibility for PR renewal? Will they be still eligible to apply for renewal or citizen if they finish the quota of years with my stay failing to meet the minimum quota of duration?

so confused. Please share your thoughts..

thanks

A Canadian permanent resident must comply with a residency with respect to a five-year period. In that five-year period, he or she should be physically present in Canada, for a total of 730 days. It is not mandatory for a continuous presence. In your case check what would be the accumulated days of your presence in Canada.

Although as per the law to maintain Permanent Residency one has to stay 2 years out of 5 years and it may not be continuous but at the same time it is also seen as to what is the intention of the applicant. Is the intention to make Canada ones home country and have ties to it or just abusing the system. I have seen people being ordered to leave Canada although they fulfilled residency requirement.
Living and working in US and visiting Canada on weekends to accumulate days will definately come to the notice at the time of renewal/ handing over of PR card some tough questions will be asked. Your family was all the time present, so they will have no issues. They will not be effected by your PR renewal outcome.

Hi,

I am also curious from folks, what are the details of documents to be attached as proof to substantiate your stay and satisfy the minimum years, eligible for renewal of PR?

thanks in advance
