I am 2013 applicant...My time is as follows
1.application process started in may 2013 in NOC Code 0211(Engineering Managers)
2.got medical request in Dec 2013.
3.got physical Background check in April 2014
4.CIC sent procedural fairness letter in Sep2014 as they have doubt in my experience and some inconsistencies in my office.
5.Got DECISION MADE in JAN 2015. AND decision is

REJECTION LETTER WITH 2 YEARS INADMISSIBILITY. as per section 40(1)(a),40(2)(a) and section 11(1) of IMMIGRATION and REFUGEE Protection ACT.

seniors pls suggest...what should be my next step....
1.shall I appeal to same.
2.Wait for 2years

Major concern:- how could i remove my inadmissibility. could it be automatically removed after 2 years or i have to do something?Could it br removed before by some appeal.

Another Question:- and after 2 years will CIC count my work experience from beginning or have they made my work experience zero till date...?

DISCRIPTION OF IMMIGRATION AND REFUGEE PROTECTION ACT.

40. (1) A permanent resident or a foreign national is inadmissible for misrepresentation
(a) for directly or indirectly misrepresenting or withholding material facts relating to a
relevant matter that induces or could induce an error in the administration of this Act.

A40(2): The permanent resident or the foreign national continues to be inadmissible for
misrepresentation for a period of two years following, in the case of a determination
outside Canada, a final determination of inadmissibility under subsection A40(1) or, in
the case of a determination in Canada, the date the removal order is enforced.

SEC 11 (1) :- "A foreign National Must,Before Entering CANADA,Apply to an Officer for VISA,
or any other documents required by regulation,The VISA or Documents shall be issue if ,
Following an examination,the officer is satisfied that foreign national is not inadmissible
and meet the requirement of this ACT.

Some People have reported that their application has been transferred to Poland Visa Office .

They might have done this to speed up the process

Not to worry of Vin, your application along with some others, including myself, seems to have been transferred to Warsaw VO instead of NDVO. See 12773 page onwards of this ultimate forum. Let see what kind of communication we will receive afterwards from Warsaw VO.

Hi mate, first of all .. congratulation on receiving the MR :)

Secondly, what medicines we are taking are out of scope in medical tests that we undergo for immigration.

Read this for General Medical Exam Stuff :

(1) Urinalysis (protein, glucose and blood by dipstick — if blood positive then microscopic report required) for applicants five (5) years and over.
(2) Serological test for syphilis for applicants fifteen (15) years and over.
(3) HIV testing for applicants fifteen (15) years of age and over, as well as on those children who have received blood or blood products, have a known HIV positive mother, are potential adoptees, or with an identified risk. An ELISA HIV screening test should be done for HIV 1 and HIV 2.
(4) Serum creatinine if the applicant has hypertension, diabetes, autoimmune disorder, persistent proteinuria, or kidney disorder.
And other tests as mandated by the DMP handbook.
(5) vision test
(6) Chest xray
(7) BP check

CLUE : Do not disclose any of your illness/medical history unless you think that will be disclosed in blood/urine tests.

And usually, Diabetes is the one common thing that shows up in blood test. So, other than this you need not disclose any of your illness.

Be positive. Do not worry much.

So...what you want to convey with this..?? Panic..??

Info. u hv pasted is old and is just a single case ppl hv come around recently. Sorry for "that" applicant but VO had found something extreme mismatch in his case and gave rejection at this stage which is very very very very rare.

No need to worry if everything is alright according to ur NOC and at your work place.

Unless you have "cooked it or faked it", you are absolutely fine.

Kind request to you brother is.....Don't just let ppl know when rejection can happen. Do let others know, what went wrong in that case too.

People here are taking support of each other and warm words from the brothers / sisters (who in-fact may have not met or know eachother before) are soothing eachother's pain.

At this time, I think no need to come up with such Panic news.

Nothing personal bro.!

If you have been completely HONEST in your documents and information provided, you are IN..!!

Man !! Why are you worrying ? One specific case and we have started panicking .

Have you faked your Job ? Have you faked your PCC and have a criminal Background ?

Have you provided fake Job Description when you actually don't fit into that NOC ?


If not .. then don't worry .. Chances are less than minimal
