I am planning to immigrate to Canada Soon. I'm having my father and elder sister, who is now 38 years old and is mentally slow, however she is physical fine. I'll be able to call my father to canada on a super visa or visitor visa. But how can i able to get PR for my elder sister as no one will be there to take care of her, since my father is old. Kindly suggest.
 
At this time you cannot sponsor your sister for PR. If there's a point in the future where both of your parents are deceased, when you have no spouse or children or other other family members in Canada (e.g. aunt, uncle) - then it's possible you may qualify to try to sponsor your sister for PR. However there's also a good chance her application may be refused if CIC feels she will place a burden on Canada's social care systems (since she's unable to work or take care of herself). Unfortunately it's quite possible she may never be able to come to Canada and you will need to find a way to have her taken care of in her home country.
 
Typically sponsoring siblings is incredibly hard, if not impossible to do.

You should really be proceeding with your plan to immigrate to Canada, under the assumption that you will never be able to sponsor your sister for PR, ever. If this scenario is unacceptable to you, then you really need to reconsider your own immigration plans.

When you sponsor your father for PR, you can try including your sister as a dependent in that application. It's unfortunately impossible for any of us to say whether this will work out or not. A court case (appeal) will be expensive and may not help at all.

Note that you won't be able to sponsor your father for PR until at least four years after you have become a PR yourself and moved to Canada. Before you can sponsor your father for PR, you will first need to work at least three full years in Canada and make enough money through a job in Canada to meet the income requirements to sponsor him.

While you wait to qualify to sponsor your father for PR, you can have him visit Canada on either a super visa or regular visitor visa. I think it's highly unlikely your sister will be approved for a visitor visa. So that's something you will need to keep in mind.

As mentioned it will probably be around 4 years after arriving in Canada and you making enough income, until you would be eligible and can even consider sponsoring your parents. There is a lottery now to sponsor parents with many people not being selected. And in 4-5 years time, who knows what the system in place will be, or the odds to get selected. It may be a decade or more of waiting, with some people simply never being selected.

The problem with including your sister on your parents app, is that if you can convince IRCC she's dependent on them due to a disability, then that same disability may cause her to fail the excessive demand requirement of the medical exam (meaning she would be considered too expensive for Canadian health and social services). These types of cases are very unpredictable.

Going through courts and appeals is also a very slim chance of being successful.

You really need to proceed with immigration here under the likely scenario you will never be able to sponsor your father and sister. As long as this is acceptable to you, then by all means you can try any means available once you become a PR and hope for the best, but don't be surprised if all routes are unsuccessful so make sure to have a backup plan (like arranging care for your sister in home country, or being prepared to move back to home country yourself).

Thank you guys for your kind support. I have heard some province like Manitoba have such provisions to call your family but not pretty sure about it. Any suggestions? Or if a family visa can solve my problem. Any knowledge upon it? Thanks

The Manitoba program gives an applicant additional points for having family in the province - but the applicant still needs to qualify for the program on their own through having a job offer, the required work experience, sufficient education, the minimum language test scores, etc. I don't see this being in any way feasible for your sister.

I don't know what you mean by a family visa.

You really need to assume and plan for the fact that your sister will most likely never be able to live in Canada. That's unfortunately the most likely outcome.
