Would some kind soul help me with questions 13 and 14 of Form IMM 0008 in the light of the following info. I am an UK citizen and have been living in the UK with a Canadian citizen for about 14 years. We want to move to BC. She is to be my sponsor under the family class, I being her common law partner. I am however married to another woman, but the marriage is subject to a decree of judicial separation. That not-all-that- common decree is not one of the options in any of the click boxes in any of the forms. It is not the same as 'legally separated' as defined in the guide. Its effect is to terminate all the rights and obligations under the marriage without dissolving it; so the spouses remain married and cannot marry another. Who do I name in my answer to question 13? What I propose to do is to name my common law partner (who is also my sponsor) in answer to this question. She, after all, is the most 'current' Is that what is expected? I am not happy about it because a common law partnership is not correctly referred to as a 'marital' status; but since that is one of the choices in the click box I think on balance the course I propose is correct. Anyone disagree? Question 14 in the same circumstances also poses a problem: it assumes that the marriage is a previous marriage and that it has come to an end. My marriage has not technically come to an end and I consequently cannot give an end date in the last box. On balance however I think my wife is a person to whom I have been 'previously' married and that I should refer to her in answer to this question. Anyone disagree with this? I have added to my answers a long spiel explaining that I do not know how to answer the questions and explaining why I have answered them as above. Spiel is dated and signed and will be clipped to the form. Is that OK?
