Hi There -

I am a Canadian Citizen who is sponsoring my husband who is a US Citizen. We live close to the US/Canada border but are so excited to finally start our life under one roof. My husband has two dependent children from a previous marriage, who will NOT be accompanying him to Canada and will remain in Buffalo, USA - therefore, I am not sponsoring them.

I understand that we still have to declare them as dependents and completed medicals for them but my question pertains for FORM 5481 particularly. Do I list them on question 6B, even though they are not being sponsored?

Actually yes you are sponsoring them, except they are non-accompanying. They must be listed in form 0008, question 3.

Who should be included in this application?
If you are being sponsored as a member of the family class, your spouse or common-law partner (except where your spouse or common-law partner is the sponsor) must be included in your application as a family member. You must also include all your dependent children from your current and previous relationships, whether they will be going with you to Canada (accompanying family members) or not (non-accompanying family members)

Generic Application Form for Canada (IMM 0008)
Question 3 - Indicate the total number of family members included in your application. This includes yourself and any family members, regardless of whether they intend to accompany you to Canada or not



So in form 5481 you will have "3" entered in 5 A) Current Undertaking.
 
Thank you for your quick response. Does this mean that we will have to pay the sponsorship fee for his dependent children even if they are not moving to Canada/receiving PR status?

I believe so, but you would not need to pay the RPRF (Right of PR fee). Others can confirm this.
 
no you don't have to pay any fees at all.

Yes you have to pay 150$ for the dependent children but not the Right to permanent residency fee for them, even if they were accompanying as well. But its 150$ per dependent child.
 
You don't pay any fees for non accompany . Medicals ,police checks and photos no fees apply.

I just did it and sent it in, after calling them to confirm. They said even if not accompanying I had to pay the 150$.

Incorrect. Fees are not paid for non-accompanying dependents.

Well, they owe me 150$. smh. They told me I had to pay (I am doing Inland - if that makes it any different)

Nope, doesn't make a difference. They will refund you.

Next time check here first .. cic is always making mistakes .. they will send you a refund eventually .
