Hello, I'm new here and I'm joping that someone can help me.

My Son's Fiance is here in Ontario on a one year work visa which expires in April 2011. He wishes to sponsor her as his common-law wife. They met in December 2008 in the UK at a family wedding and she came to Canada twice in 2009 to visit. He moved to the UK last November and lived there with her for 5 months. They got engaged in the UK last December. She applied and was granted a work visa in April of this year and they both came here to Canada where they live together with myself and my husband. They planned to marry next summer but she has just found out that she is pregnant, the baby is due in June so we need to get their application in as soon as possible but we really don't know where to start. I'm worried that her OHIP will run out before the baby is born and that they will have huge healthcare costs.

Can anyone tell me what the first step is? Does she need to apply for an extension to her work visa before the application for PR or do they submit them together?

Any assistance would be greatly appreciated.

To apply common law they are going to have to prove that they continuously lived together for 12 months. So if there was no interruption to their living together then they should meet common law. They will need more than a baby to prove their relationship is genuine. They need statements from friends and relatives, bank accounts showing joint names, life insurance policies if they have them, chat logs, cards, letters, phone logs -anything that can prove that they are genuine.

I dont know about the work permit but it might be worth applying for but closer to the expiration. THey should get the spousal sponsorship started ASAP if they have met the 12 months.
