Hi folks,

My visa has been rejected 2 times (SDS Category) for Humber College Post Graduate Diploma (Ontario Graduate Certificate) - Global Business Management course (May 2020 intake).

Reason (both times) - I am not satisfied that you will leave Canada at the end of your stay, as stipulated in subsection 216(1) of the IRPR, based on the purpose of your visit.

I have studied bachelor’s of business management previously and graduated in August 2019 (77%).
I then worked as a marketing executive for 7 months (October 2019 to April 2020). I am not doing anything since May 2020 to February 2021. I am 23 years old Indian citizen living in India.

1st Filing was done on 24th January 2020 and got refusal on 2nd February 2020
2nd Filing was done on 26th February 2020 and got refusal on 3rd March 2020

After 2 refusals, I applied for CAIPS notes which stated :

GCMS/CAIPS Notes for 1st Refusal -

Application reviewed. Client received a Bachelor in Business Management (2019). Client wants to attend Global Business Management at Humber College. On review of all information including PA's previous employment and educational history, their motivation to pursue studies in Canada at this point does not seem reasonable. Study plan submitted is general and I am not satisfied with client's explanation of career benefits. Chosen program at the college level at such an expense is illogical in light of PA's reported scholarly and/or work history. Considering previous academic education, employment history, personal establishments and ties to home country, I am not satisfied that the applicant would be a bonda fide student in Canada and would depart Canada at the end of the period authorised for stay. Application refused.

GCMS/CAIPS Notes for 2nd Refusal -

Application, documents submitted and GCMS history reviewed. Previous refusal noted. Applicant wants to attend Humber College Institute of Technology and Advanced Learning for Global Business Management. Considering applicant's extensive education and previous work experience in the same field, I am not satisfied that applicant would not have already achieved the benefits of this program. It is not evident why applicant would study this program at sch great expense considering applicant already possess a higher level of qualification. Client has a Bachelor of Arts with Honours in Business Management. I am not satisfied that this is a reasonable progression of studies, which raises concerns regarding applicant's intended purpose in Canada.
Not satisfied on balance that applicant is a genuine student who would respect terms of authorized stay, nor that S-1 is not facilitate entry to Canada for other unknown reasons. Application refused.

During my second time study permit filing, I was working and I got an official resumption of work letter on official letterhead which stated I will join this company back after my studies in Canada. However, this company is permanently shut down due to pandemic.

My IELTS is 7.0 with 6 and above. (Valid till June 2021)

I have considered changing my institute and I currently have offer letter from a good state run/ government University’s MBA program | September 2021.

This University’s MBA does not offer a specialisation but the core modules in a particular field (marketing, finance, HR etc) can be selected in second year and I intend to choose elective modules related to Marketing.

Question 1 - How to convince the Visa Officer this time?

Question 2 - How to justify my 8-9 months gap where I didn’t do anything? (may 2020 to february 2021)

Question 3 - What additional documents can I attach to demonstrate family ties, home ties? (I am the only child) | (During 2nd attempt of visa filing, I attached Sponsorship affidavit, Father's ITR, Father's Salary Slip, Provident Fund, An employment resumption letter from my previous organisation)
This time, I plan to attach CA Report which states 3 properties under my father's name, available funds, father's annual salary and jewelry.

Question 4 - What is the ideal time for visa filing for September 2021 intake?

Question 5 - I have never travelled out of India so how can I justify my travel history.

I humbly request you peeps to help me out.

I doubt you will get approved after two rejections and not changing your situation or advancing in any way since.

Are you also seriously asking if you should lie and misrepresent yourself on the application? You can get banned for 5 years.

What is your personal reasoning for studying in Canada? What justifies the costs of this and how will it make a huge difference in your life back home once you are don studying? From reading your post, I think the agent was justified in denying you. Unfortunately it doesn't seem like you have given them strong reasons for needing the education, specifically from Canada.. Best of luck.

I am sorry about that. I'd never misrepresent myself.

I have changed my course and currently it is a Master's Level Program (MBA) with core in Marketing which is my area of interest.

The MBA is from a reputed Public Run (Government Funded) University.

If I draft a strong SOP which answers every question, do you think it can help me get the permit? Cus I genuinely want to study there.

Then this would not be relevant to your application nor would you include it . Basically you have no job to return too, but if you include this letter you’re leading the VO to believe you do . That’s misrepresentation

May you pls help me out? What shall I do?
If possible, engage a good immigration consultant to address all the concerns. There are people who have been approved at the third attempt. You'd have to address all the concerns, not just a strong LoE.
- previous academic education, employment history, personal establishments and ties to home country, career progression, post program benefits

I am seeking assistance from a consultant. They will be drafting the SOP addressing the enclosed concerns. I was looking forward to gather more perspective from the members of this portal.

Again, you haven't really provided a strong enough reason for spending a lot of money to study in Canada. If you no longer have strong ties to home, this will not help as your position seems to have worsened since the two rejections. I would hold off, establish yourself further, and once you have stronger ties to home and more convincing reasons to need an MBA from Canada - try applying again. It doesn't make sense to reapply if nothing about your application/personal situation has not improved to justify studying in Canada.

It'll be best for you to seek a good consultant to help you with this, as others have pointed out. Maybe even seek programs you might be interested in closer to home, I'm sure that Europe has great programs as well and might be an easier approach for you.

Hi, Usually they release GCMS notes within 30 days of application. Could you please submit a query through IRCC Web form raising your concern? Once you get the GCMS notes, prepare a SOP addressing each and every concern raised by the officer. You may want to seek help of a reputed immigration consultant/lawyer, as inadequate explanation may lead to further rejection. Thanks and wish you Good luck.

Hey i got it. and its stated;

The applicant has failed to satisfied me that pursuing the selected program of study is reasonable given the high cost of international study in canada when weighed against the potential career/employeement benefits after completion, and the local option available for similar studies.

Marksheets provided indicate poor acedemic record in areas of study that would form core of future studies, i have concerns that applicant will be able to successfully complete the study program.

Given the applicants previous education/Employeement history, i am not satisfied the motivation to pursue this perticular program at this point in time in canada is reasonable; see LOA.

Therefore i am not satisfied that applicant would be a bonafied student in canada who will leave canada by the end of the period authorized for thier study.

pls help me what should i do next ? could you pls share any lawyer's contact, so i can consult spesifically.
