Filing for an Outland while waiting on TRV Extension

Hi all,

I have been working on my paperwork for months, and it is finally about ready to be sent off. I have been "staying" with my husband in Canada since we got married in June 2014.

My original TRV expired in July but I had filed for an extension which I received till February. We had estimated being done with the paperwork by then, but faced some setbacks so I have applied for my second extension which I believe may still be getting processed.

QUESTION: Can I send out my outland application while my second extension is in process? Maybe send proof of receipt for it? Or would I need to wait on the extension to arrive and attach that to the application?

The only reason I was a little skeptical was because in the supporting documents, it mentions to send your visa or status on which you are currently in Canada. I just don't want them to think I'm out of status.

Since you have already filed for an extension of your visitor status and it is currently being processed, I believe you fall under "implied status" until CIC makes a decision on your extension request (note that this is different than the "implied status" that comes with Inland-OWP applications).

CIC will probably not have any issues with your waiting for an extension, so you can mark your current status as "visitor, extension request filed [DATE], and they will be able to see it on their system (assuming you applied online for the extension).

In my opinion: don't sweat it. Just show that you took steps to maintain status.

You don't have to wait for the extension to be processed to apply Outland. I applied for my 2nd visitor extension a few weeks before mailing my Outland PR sponsorship. According to the processing timelines, my visa extension was running a little bit behind schedule, but a week after we got Sponsor Approval, I got my visa extension, which leads me to wonder if the CIC person holding my extension request wanted to make sure my PR sponsorship was legit before making a decision.
