Hi
i received a refusal letter on 23rd october from CHC New delhi mentioning you do not have enough poits to qualify for PR. They count 63 points.
They have not counted any points for arrenged employment though i have 2 years temporary work permit followed by positibe LMO as food counter attendent.

Shall i contact chc delhi for request of consideration.

Plz reply soon.

DId you have an approved AEO? You know that food counter attendant is not considered skilled work?

Plz ignore my ignorance abt the PR process, I need to know are points awarded for LMO especially when its a temporary one?.As far as i know points are only awarded for HRSDC approved AEO if its permanent.Plz correct if I m wrong.

A positive LMO is not sufficient for arranged employment under the Federal Skilled Workers program. It has to be NOC skill level O, A, or B, (Food counter attendent is NOC 6641, skill level D, it does not qualify), AND it has to be accompanied by a job contract or letter from your employer stating that the job offer is for permanent employment.

If you work here for 2 years, perhaps you can qualify under the CEC program...

Hi TomDick,

There are two categories of "arranged employment", one is for those not in Canada (they require an AEO), and one is only for those currently in Canada. For the latter, the LMO is part of the documentation required to demonstrate arranged employment, but by itself does not get any points (other documentation is also required).

I understand that Food counter attendant is not a skilled work but My application was already assesed on the basis of Noc 4131 College and vocational instructor under what i already qualify. So i feel that POSITIVE LMO with work permit for Food counter attendant should be considered as adaptibility.
But i m not sure please reply.

I understand your confusion. It does not explicitly state in the instruction guide that the "arranged employment" must be in Skill Type O, A, or B, but this is stated in the OP 6 (instructions to visa officers):

"Section 10.13—Arranged employment
• arranged employment must be in National Occupational Classification (NOC) Skill Type 0 or
Skill Level A or B [R82(2)];"

So, you will not get any points for arranged employment. You will have to find the points elsewhere. Or, go ahead and work in Canada for a couple of years, you will have more points, or possibly qualify under CEC.

Thanks so i will not qualify to get extra points but here is one more possibility my current employer is ready offer me a permenent job offer so if he needs apply for AEO or new LMO or just permenent offer on company's letter head will be good?

or if i get AEO or NEW positive LMO then can i request CHC N.Delhi to consider these points or else i will have to submit new application from within the CAnada.

So can you clarify,
1) You are currently working in Canada? How long have you been here?
2) What is your current job / NOC? (Sounds like the food counter job is a different job, yes?).
3) For how much longer is your current work permit valid?

IF your current job is NOC O,A,or B, you have a current valid TWP, to re-apply (to CIO-Sydney) all you need is the letter on letterhead from your current employer stating that you are offered permanent employment if you obtain permanent residency.

I don't know if you can appeal to CHC New Delhi with new information, at this point. May be just as fast to start over...

I have been in canada for 9 months.
My NOC code for current job is 6641.
My current Work permit valid till February 2011.
Also plz advise if my employer wants to help me in New PR Application, what is better either AEO or New LMO with promotionwith permenent job offer?
Also send me link for the process of LMO or AEO.

Since your current work permit is valid until Feb 2011, then you don't need to apply for for a new permit OR AEO at this point. You can apply now under Category 2, arranged employment.

Re-submit your application with a copy of your work permit, the LMO, AND a letter from your employer that states that you are offered a permanent position if you obtain permanent residency.

Your work permit will have to be valid when the visa is issued, so do it soon, to allow sufficient time for processing. If the process is not complete, you will have to apply for a new LMO and work permit at least a month before it expires.

Sorry, thought the food counter job was NOT your current job.

Once again, your food counter job will NOT qualify for "arranged employment". If you are looking for extra points to qualify under Cat 3, this will not work, either.

For occupations that are not O,A, or B, you have another option - the Canadian Experience Class - once you have been here for 2 years. For how long have you already been in Canada?

Also, you might look into your provincial nominee program...

I have been here in canada for 9 months, i talk to my employer and he is ready to apply for AEO. (is thia a good option?)
