*male-female/6ish yr relationship. I go back and forth to visit 1.5-2 months at a time yearly except for 2020 and this year.

*partner is married, but her husband is estranged, no contact for years.

*divorce is not allowed in the country(Philippines) and its illegal to cohabitate with a married person there.

Now my questions are:

*Should I try for a visitor visa first or jump to conjugal sponsorship? is common law even feasible?

*Is getting married to a different country an option or that's a no since since the first marriage would be considered?

*tips to strengthen the application for both travel visa and sponsorship?

You need a TRV to be denied before you can file the conjugal application. You can’t get remarried before getting divorced.

we will try the TRV first asap. Unfortunately divorce is out of the table as its not allowed in the Philippines.

Some Philippinos are able to get a divorce in another country for their Philippine marriage which is why I suggested the potential option.

unfortunately its only allowed if the partner was a foreigner. so you can divorce then. but if its with a Filipino citizen its a no.

If you are living in Canada or another country you can get a divorce. It may not be recognized by the Philippines but that doesn’t matter. What is important is that Canada recognizes the divorce. Assume there is probably no way for her to get a divorce from another country if she went on holiday while living in the Philippines but I can’t guarantee that. Your safest bet is apply for a TRV. If denied apply for conjugal. If you have visited her every 1.5-2 years and there are no red flags it should be fine.
