I want to teach them a lesson, parcel insurance is 100$, I am going to dispute delivery, and say its not delivered - show me signature.
Then, I'll send notice of intention to sue, if they refuse to show proof of delivery, OR compensate for lost package.
I see no reason for a judge to deny the claim, its part of the contract - no signature? not considered delivered as far as I can tell...
Small claims fee is 102$ - I'd get it back once I win..

I doubt Fedex will let it reach all the way to the court though... its not good for their reputation to have court decisions against them on public records.



Yes I just did - nothing mentioning signature on the waybill agreement.
If it during COVID 19, no signature. No contact. All delivery dropped at designated area and no signature taken. (Period) I have small claim similar with Canada post.

Yes, so they shouldn't have charged him $100 for the service if they won't do it due to COVID. That logic doesn't make much sense.

In any case, neither does OP make much sense. They got the name and that is more useful than some illegible signature. OP is pretty much guaranteed to get laughed out of court because a name may suffice as a signature. But it's their money being wasted not ours, so no point talking them out of it.

There is no claim they still have to get the name of the person receiving and the time that it was received. If it was no signature required it could be left at a doorway, in a mailbox, etc.

The service is to provide delivery to an actual person. Instead of having a signature they have a name. Nobody dropped of the package at a door.

Keep in mind, should a court rule against you, they can actually award costs to the defendant. That would leave you on the hook for some very expensive lawyer cost for FedEx. You won’t be teaching them anything.
