Dear All,
I just recieved my FBI record after 8 weeks. I had a detention record with US Immigration when i was in USA. The record shows in the report:
"ARRESTED OR RECEIVED 2003/10/31
AGENCY - USINS DIST OFFICE DALLAS (TXINSDL00)
AGENCY CASE - 12998620
CHARGE 1-INA 237 (A) (1) (C) (I) - NONIMMIGRANT VIOLATOR OF STATUS"
RECORD UPDATE 2010/07/01"
Now i have mentioned about this with my initial application to CIO. However, after i was being held in detention for 3 hours, i was let go and asked to show up on court date in which i had presented all the evidences to the court. The proceeding was terminated as there was no fault from my part. I just couldn't provide the officers with evidence at the time they raided my apartment.
I have the original court order with me that shows that the case was terminated. After that incident i stayed in USA for another 4 years and completed both my Bachelors and Masters from there.
Now, in 2007, i applied for US visitor visa and i was denied the visa on the ground that i was not forthcoming with the VO about my past history in USA. I really did not have time then to dig through the reason and challenge the decision as i got very busy with other part of my life (finding jobs and getting settled in my home country after coming back 9 years later).
But now, when i see this in the report, it appears that the record is not updated with the final decision of the court. It simply says that i was arrested. But doesnt say that i was not guilty after the hearing. Now it might be he reason why i was denied visa to US 3 years back.
Now my question is that, is it normal for FBI report to not have the final outcome of a case? Because it says at the bottom that "RECORD UPDATE 2010/07/01" - probably stating that it has no update on this icase after my arrest.
I have provided my court copy to CIO and also mentioned that i was denied visa on ground of "not being forthcoming". I hope CIO takes it easy..
But how i can work out this FBI record.? Is it normal or it should have shown the final outcome as well!!
please help as i must act on this. Its like a dark spot on my life..that i must rinse before moving forward.
