M y wife lived in the USA 6 years ago and has not returned since then, we are n Taian now .W e had a background check done 6 months ago from the FBI. The canadian website say that the check must be within 3 months, will it matter that its from 6 months ago considering she hasnt been in the us for 6 years and and can prove this with her passport? It makessence to me that this would be no problem but with the government younever know.
 
Unfortunately you'll need to obtain a new one. It doesn't matter that she hasn't been to the US in six years. CIC will still want to see an FBI report that is less than three months old.

If our FBI report is dated the end of June, we submitted our file at the end of August but did not submit FBI report. Is it still valid or we need new one. We got the file number and we will forward it now. Do we need new one?
 
Technically (per CIC rules) it's no longer valid. It cannot be older than three months.
 
But does it go from June to August (We submitted ours in August) or they do not take a look at the application date.
 
You submitted your application in August WITHOUT the FBI report - correct? And you still have the FBI certificate which has a date of June - correct? If so, the FBI certificate is no longer valid. The FBI cert has to be no older than three months at the time it is submitted to CIC. The fact that you submitted your application (without the FBI cert.) in August means nothing. In other words, the application date doesn't matter. The date that matters is when CIC physically receives the FBI cert.
 
that makes no sence at all, di she go back in a time mcahine and commit a crime 10 years ago? Are you sure about this? i cant get through to the call centre. Wont they make an exception in this case since its obvious she doesnt have a criminal record in the US?
 
ours was more than three months old. It was basically expired at the time it was submitted and they still accepted. At the worst, they will request you to send a new one at a later date. The only problem with that is that it could create additional delays.
 
Hopefully i can get an agent to answer this question in a few days, would I be able to apply with the old FBI certicicate, explain the circumstances and have my wife do a new one immediatly that I could send them asap? Will they at least process my ability to sponsor without the new police check? Ill let you guys know if i ever get a hold of an actual person on the phone.
 
It is not a problem for you to be approved as the sponsor. It is when the application will reach the embassy, that they will ask you for a new one.
