In the middle of 2010 I received my PR as a FSW and stayed in Toronto for a month but soon realised I wasnt quite ready to stay permanently

I now have a family together for 2 years and a new baby girl. We would like to now move to Canada together however I when I asked questions before it didnt seem simple. Can we apply for them to join me prior to going out? I dont want to be in a situation where we are apart for 6 months as that simply isnt feasible with a young baby as they rely on my income. If I have to reapply I have to do so under IT manager which I dont think is in the list at the moment

Suggestions welcome. I know time is ticking and need to complete 2 years in 5 to be eligible to stay?

I am not sure if there is a short cut to this.

IMHO don't lose your PR status and think of applying again. there might be some changes and you might not be eligible according to the new rules (if they make changes to the point system). So, My advice is go to canada and start the process of sponsoring your family.

I would need to bring them with me even if they enter as visiting for a few months with open return tickets

Is that a possibility? I know losing PR would be a big thing but leaving family/new born behind isnt an option

I am British my partner is Lithuanian. I am father of one and step father of the other.

They are ur dependants.......so may not be granted visitor visa by immigration officer thinking they won't leave Canada after stipulated time.

Though you can try and if that fails do as w_aamr said "by starting the process of sponsoring your family"

As a PR, you cannot sponsor your family from outside of Canada (only citizens can sponsor family from outside of Canada). So you have no choice but to return to Canada and sponsor your family from here. You must also remain in Canada while the sponsorship application is being processed. Occasional short visits (2-3 weeks) outside of Canada are OK. Anything longer and you risk having the file rejected due to non-residency.

As for your family, then can try to come to Canada to wait out the process here as visitors. If they hold passports from visa exempt countries, then they can visit on their passport alone. If they are not visa exempt, they will need to apply for a TRV (temporary resident visa) before they visit. If they require TRVs - there is no guarantee they will be approved.

you don't have to leave them behind. both your partner and kid are from visa exempt countries (Lithuanians need to make sure they hold e-passport). they do not require a visa to visit Canada.

I guess that is as good as it can get. just Pack your bags and get your tickets. :) good luck

It was the part about them being turned away because the Visa Officer believed they would outstay their Visa which was worrying me

It's a big risk. Was looking for feedback on that aspect

What I don't know is how long do they allow visitors from visa exempt countries to stay?

you should be concerned if you need to apply for a visa at the embassy prior to your travel, because then they will want to make sure that the visitor has enough ties to his/her country of origin.

However, your case is different. your partner and child are allowed to enter Canada without having to make visa application prior to they travel.

just make sure that they don't overstay their visa because i guess that will complicate things when you apply for their PR.
