Hello I just have a couple questions.
My Husband appointed me as a representative because of reading and writing language barriers though he speaks English well he had me do the application as he feels more comfortable.
we’ve been through a lot in the last two years with visitor Visa being denied due to me being a significant Tide to Canada even though we wanted him to visit before we decided we wanted to proceed with living in Canada. as it is a joint decision about our future.
We got married in October and due to the pandemic and work situation’s we decided that we would hope for the visitor visa but proceed with the spousal sponsorship. We actually heard back about the TRV during our honeymoon about 5 days after the conception date. We didn’t know we were expecting yet. We were just hoping for a visit to celebrate our marriage with friends and family that were upset I got married in a small ceremony overseas with only our parents present- covid allowed not much.
so I travelled back in December to visit lawyers and get all of our documents translated to his photos and gather all of the information and go through the papers and sign them all together.
in February I found out that I was almost a month pregnant which happened on our honeymoon in January.
So needless to say the forms and photos that we had done were signed and dated December.
I was able to fill out the online special application so some of the IMM forms are actually dated and signed within the last 90 days however some of the paper documents that we scanned were signed in December.
I was informed after submission recently that this can be an issue and that photos also have to be taken within 90 days to be relevant, We have not received an application number or confirmation that processing has begun however I’m aware of this issue they call stale dating.
Does anyone know what I should do I work 50 to 60 hours a week and then travel every 6 to 8 weeks so that we can maintain our relationship and I worked very hard to make sure that the application is done correctly in every other way.
of that I am sure that it is complete but this issue is making me really nervous I am now 14 weeks pregnant and through the first trimester and started getting a little bit more energy which was how I was able to completely complete the application and get it sent in I only had a few hours of celebrating the fact before it was brought to my attention and I need to know what I can do.
I have the option to start another application altogether and use all of the same documents and I’m travelling to see him again in about 10 days would it be smart to resubmit the application without stale dating and indicate that on the application title (re-submission) as well! We can just re-do the forms… I also didn’t check to see if the versions of the forms had changed so this would give us the opportunity to do that as well.
We were prepared to
Submit photos that are less then a week old in two weeks, and had planned to have to do the police check and certified translation of that again, because that needs to be done more recent then December and won’t be relevant by approval since processing times are so long- but had to be included for the application to be complete. (it’s just over 3 months old now too) but had to be included (That one is a necessary evil feom
What I understand), and it’s a common issue.
I can’t explain how heartbreaking this was to be told about too late; since we are dealing with a lot and the baby is coming in 6 months regardless of IRCC processing stuff. It is my fault it took me so long to really get through doing the application and the pregnancy and work had a lot to do with it. I have been so exhausted being pregnant and really sick- it was a tough high risk pregnancy and we had been trying awhile so I was trying to balance work and life and pick away at the application.
any help would or advice would be appreciated. We are so stressed about being apart as many may understand I miss my husband and this process is overwhelming to sort through 3 years of communication and gather all supporting documents never mind pregnancy symptoms.
also any thoughts about applying for a dual intent TRV again to appeal the decision based on decision to proceed with sponsorship and an explanation that it would have been our intent once he had visited to decide if he would like living here - I still am and was also willing to move to his country if we thought we would like it there better.
We can always decide that in future before citizenship is granted - but it wasn’t ideal.
This is a crazy obstacle when you’re trying to have a normal relationship and make decision for the future.
