Family class spousal sponsorship (Outland) with H&C Considerations

Is there anyone in this forum applied under Family class sponsorship with H&C considerations, asking IRCC to grant an exemption for Inadmissibility. I would like to know how long it usually takes to hear Stage 1 Decision, here's my timeline for your reference. Again this is not a typical H&C application.

So truthfully we see extremely few cases here like this. I would say less than one a year. For that reason I'm not sure how much feedback you are going to get on processing times. Your case is very unique.

As I understand it, your application follows the spousal sponsorship process and not the H&C process in terms of steps. So as far as I know there is no Stage 1 approval like there is for direct H&C applications. Instead, the spousal sponsorship process for Outland will be followed meaning that they will determined the sponsor eligibility first (which would be straight forward in this case) and will then review the applicant's inadmissibility as part of the eligibility / background / security check stages. So essentially this means you are waiting for final approval to know you are good. I do not believe you will receive any sort of Stage 1 approval. That's my understanding but a lawyer may be on a better position to advise.

... I haven't, but my husband has been escalating abuse against me since I got back to Canada so I'm starting to get concerned.

What inadmissibility are you asking to be exempted? My husband currently has an Outland Spousal PR application in process as well as a Criminal Rehabilitation application for serious criminality. If the CR is not approved then we will apply for H&C consideration.

Nvm, I remember talking to you now and remember the reason. There are not many of us with these unique situations so it is very nerve wracking not knowing what our timelines should look like.

Just a quick update here:

November 14th: I could see Eligibility completed on the tracker. Background Verification is still in progress. No ghost updates since the Eligibility update nor a pre-arrival letter received.

@scylla I have seen couple ghost updates (Dec 8, Jan 1st) since the completion of the Eligibility. Background verification is In Progress since the submission of my application. Do you know whether they go for Comprehensive Security screening and delay more with Background checks or it has nothing to do with my Inadmissibility. Also, I see the comprehensive security screening is mainly for Inland applicants from specific countries or someone having Military background.

Sorry, I am just so anxious and eagerly waiting for the Final decision/Passport request. Seeing Eligibility completed on the tracker relieved me though, but now the background verification is taking so long.

You should, IMO, consider that the background verification/inadmissibility consideration are all part of the same thing. I don't know if there's any way to determine from the tracker, and quite possibly wouldn't be clear from the GCMS notes either (which you can and probably should of course order - but warning it's possible/likely that won't tell you what you want to know either).

Bottom line is these cases are actually quite uncommon, the moreso since we don't know (or I don't anyway) what the inadmissibility is for. You may not know anything useful for quite some time, and not until either receiving a PFL or passport request. H&C requests can take a long time, indeed even a VERY long time.

It is possible a professional (i.e. a lawyer) would be able to tell you more. Although the 'more' they may be able to tell you may only be a bit more detail on how they don't know anything either.

You're asking for 'exceptional' consideration, and there are a number of reasons such exceptional consideration is not handled normally - indeed it's right there in the name.

Thanks for your response though. I prefer not to reach out to my lawyer anymore, coz last time when i reached out He said that it would take even more time but recently told us goahead to pay RPRF after Eligibility completion. IRCC didn't even request for Re-Medical, my medical expired on January 22nd 2026. I think these are the signs that a decision would be coming our way, my case could be a reference point for any family sponsorship with H&C consideration cases.
