Hi guys,
I hope that you will be able to clarify this for me, let me explain. I am in a process to apply for PR Spousal sponsorship. My wife is PR. The application is ready to be sent, just waiting for the marriage certificate which should get here within the next few weeks. As I'm Belgian, I'm going to apply through Paris (Outland PR application) Here is my situation. My workpermit is gonna expire 12-01-2015. I'm ready to send the extend of stay as a visitor within the next days as required. Our project is that I would try to stay with my wife and her family during the processing time. Here is the complication, I get that with the extend of stay sent, I would remain under the Implied status until decision.
The point is that my wife and I are going back in my family in Belgium for Christmas. December 15 to December 30.
I understand that I am going to lose my implied status by leaving the country. And will then be treated as a new visitor End of December.
Here are my questions:
1) Is it the best plan to go through the extend of stay for 2weeks, considering that I will lose my status by leaving? The purpose is to no overstay or have a not-legal status in the country during 2 weeks.
2) By the time we will go in Belgium, my PR application will be sent for sure, so at the time I get back, and will be asked the reaason why I'm coming, should I mention anything about the PR or just that Im coming to see my family? [I know that question was asked lots of times on the forum but I'm now confused, I think that I SHOULD NOT MENTION anything about the PR right?]
3) As a new visitor, at the time I'll come back end of December, can I present my coverage as the one from my spouse. She is covering me under her benefits at work, is it valid ?
4) Should I get a return flight for a later time in 2016 to ensure that they have no doubt on the fact that I'm not there to take advantage of my visitor's status?
5) I also understood that as a visitor or even for my extend of stay application I can present a letter and some statement from my wife confirming that she would take care of my expenses. That way no proof of funds to be provided for me right?
6) A last question, I would like to confirm what is the best way for me to handle my "NEW VISITOR" status in order to come back in December. Belgium is exempted of Visa or eTA at this time, but should I go directly at the custom at the Airport in Toronto once I come back and tell them I'm just visiting or should I send an application to Paris (Processing time for visitor is 9 days) and then get the approval to come? If yes, should I do that as soon as I am in Belgium.
7) If I have to deal with Paris, does it mean that communications would be only by mail for application or can I apply through Paris via my Cic account? [silly question]
8) About the extension, to the question in the ELIGIBILITY QUESTIONS: "Are you accompanying a family member who has status in Canada?", I should definitely confirm that YES (as I would stay with my wife who is PR already right)?
